I didn't see it then. Since Ben had been pretty much absent, I was just going to let it die a quiet death. However, he has returned. Here is his statement and my current response

I am so sorry I missed this when you posted it. I had Eidetic on "ignore" at the time and you did NOT copy this offer to me.

I have ALL of our correspondence saved. You you offered me a 1/2 refund *IF* I would let you ship it back to me insured so that you could make a claim against the post office on a laser that you KNEW was already broken. That, my friend, is called mail fraud and/or insurance fraud. I will NOT participate in such a scheme.

You shipped a laser to me that was either already broken or was broken in shipment to me.

You gave a "not DOA" guarantee

It was DOA

I asked for a refund at that time, and offered to either provide it to the post office (so you could make a claim) or ship it back to you

YOU asked for me to send it to you

I did

You did NOT refund on the "Not DOA" guarantee

You accused ME of packaging it badly so that it broke in shipment to you. EVEN THOUGH IT WAS ALREADY BROKEN AND I USED YOUR PACKAGING TO SEND IT BACK.

You said it got "more broken" in shipment to you. Since it was already broken, you have absolutely no basis for that statement. It was DOA and should have been fully refunded at that time. And yet, THAT is the reason you refused to refund my money.

You NEVER offered me a full refund under your "not DOA" guarantee AND you asked me to participate in a mail fraud scheme.

You still have BOTH the laser AND ALL of my money

The RIGHT thing to do would be to send me a full refund under your "not DOA" guarantee and keep the already broken laser that I returned to you.

Until then, in my book, you are a thief and a con.

No doubt.. Hope he gets his. Really though.. how long are people going to let this guy continue to do business in this community? I've seen so many posts on several forums and groups from people who have been outright ripped off by this little punk. And we are supposed to believe that it's always some BS happening somehow so that Ben gets the upper hand right? It's always some fluke of the universe, some planetary alignment issue..

But whatever I guess, he's not getting any of my money. I'm just sorry to hear about your situation Dave..

WTF???? That is horse crap that he has both your laser and your money. Something needs to be done about this immediately.

I believe laser - ben has neg repped me 4 or 5 times because I called him out on a red HeNe he sent me for $175.00 and it was supposed to be an orange HeNe !
So every time I tryed to say something about it in open forum he would neg rep me to the tune of 4 or 5 times !!!
18 months ago this happened to me and he got away with it, I had over 20 people look at that laser and some knew what they were looking at but all said it was RED not orange !
So he's still around because no one here believed me either and did any thing about him, he's a cheating little scammer and if he ever crosses my path I will get my 175 back :D

Sorry to hear that. Here are some of the things that ben accused me of doing, so he really knows all the tricks of the trade.

His scams work in one of three ways:

First Way
Sells an item that he claims to work in a certain way and fit a certain application.
Buyer purchases the item, receives it, and it appears to be the correct item though, not tested.
Buyer leaves positive feedback
A few weeks or months later, buyer begins to use the item and realizes the item is not as it was described.
By this point, the deadline for a paypal dispute is passed, or if a dispute is filed, Ben can reference the positive feedback and say it is proof they received the right item.

Second Way
Sells an item that he claims to work in a certain way and fit a certain application.
Buyer purchases the item, receives it, and proceeds to test it.
Buyer Discovers item is not as described and complains
Seller offers a return for refund
When seller receives item, he can claim it is either not what was shipped or was damaged by buyer.

Third Way
Sells an item that he claims to work in a certain way and fit a certain application.
Seller ships empty envelope with delivery confirmation to random address in same city as buyer.
Tracking shows item as delivered to the city with no way of figuring out the actual address of delivery.
Buyer files dispute, seller wins due to proof of shipping

Ben's (ebay Member id scotchtech BANNED...) All time favorite method of scamming is:
Sells an item that he claims to work in a certain way and fit a certain application. Than DELIBERATELY packs it very poorly... the unlucky buyer purchases the item, receives it, and proceeds to test it. Buyer then discovers item is not working and complains then seller offers a return for refund. When seller recieves item, he can claim it is either not what was shipped or was damaged by buyer. Since it was a direct sale Buyer has no recourse, even with paypal.

Note he bought several NON FUNCTIONAL 15mw blue lasers off of ebay for $15.00 and sold them for $175 each outside of ebay, they were all very badly packed and shipping blamed for the damage most people would realize that the that the guts were worth considerably more than 175 so it was a non issue to most people.

ya I got screwed via proxy by laserben on PL... bought a "400mW" 473nm laserwave module from someone that bought it from him... when I got it it was doing ~300~350mW and I found out from Bridge (dude from laserwave) that it was originally shipped to LaserBen, and it was a 250mW module... I believe he sold it to the dude I bought it from as a 450mW module too or something like that

he told me to make a claim with USPS or FedEx or whoever shipped it... :gun:

so then being an idiot i decided to give him another try and bought a scientech power meter from him... when I got it, it was really well packaged, but the fuse holder was smashed... with no visible damage to the box... I told him about this and never got a response... I ended up just replacing the fuse holder myself and it seems to work fine now... whatever... thats what I get for believing that people are inherently good... not so much for ben lol

Well you see fellas. When a guy like bobH and LaserBen get so very lonely they look at all of the stupid half naked guy pics on hotmail.com's advertisements and become increasingly interested in the opposite sex :crackup::crackup:

Not to mention they are pussies to start with.

A criminal mind is a very confusing thing to understand ;)

I'm having a hard time believing that Ben is a scammer. He seemed to be a pretty nice guy, and I never had any negative experiences with him. But then again, I've never done any actual trades with him, so I definitely can't speak for everyone.

If those allegations are true, then I would be extremely dissapointed.

Someone earlier said the it appears hit or miss with Ben. You either have a good transaction or You get scammed one or the other.
