to everybody trying to find a loophole in american law.
if a case was brought against you the prosecutors would need prove forsight and malice. in which case, your very participation in this thread proves both. sometimes ignorance really is bliss

@chipdouglas - but is a criminal or civil offense to manufacture and sell a IV laser?

Seriously look at some real world cases - like when New York went after out of state stun gun sellers...

It was a civil action. Although the guns are a crime to possess in NY. The sellers faced CIVIL fines and cease and desist orders.

Federal Attorney generals will rarely go after any case where the damages are less then $20,000.

Easier to send a builder a C&D then to try and apply civil fines.

That surely is true, but if your business relies on whatever they want you to cease, you would have good incentive to ignore or fight such orders.

US legislation is extremely difficult to understand for non-lawyers, as it has less common sense built in compared to european law. EU legislation relies much more on actual trials that serve as precedent for interpretation of legislation, and much less on the exact letter of the law.

Selling a class 4 laser as a presentation pointer is illegal in the EU and probably in the US too, there is little doubt about that since it is dangerous in its proposed application. Selling it as a cutting tool or blowtorch alternative is something entirely different though, since such products are inherently dangerous and should be used with caution regardless of their exact method of operation.

Well the difference is money - dremels, band saws, and nail guns are made by big companies that have an army of lawyer lobbyists to protect them from the nanny state. I'm sure there are pols who would like to ban people from having machine and tooling shops at home, but the power tool industry would fight that.

Lasers are made by Chinese companies and unlicensed untaxed home builders neither group has any swing in DC - so come election time a pol who says "I helped keep dangerous lasers out of the hands of children and ex-cons" will look good to voters, where as a pol who say wanted people to have an ATF license to have a home machine shop would look like a socialist douche bag.

But pols have to ban stuff to prove to the voters they are "doing stuff". Regardless of party, come election time voters want to know "What have you protected us from?"

My last laser has a good loophole ;)
The original flashlight is mostly unaltered.
The diode, module, pcb connection, driver, etc. are all in a self contained separate piece.
Sell that piece and tell them where to buy the host.
The thing basically works the same as a p-60 drop in ^_^
I have not sold a complete laser, nor the components to build one.

First of all I'm not a lawyer nor have I stayed at a Holiday Inn Express recently.

I'm sure someone will correct me if I'm wrong but from my readings as of today it's not illegal to build a laser over 5mw for personal use but once you start distributing them free or for a charge you have to meet all the FDA guidelines and requirements. Failure to do so can result in a massive fine up to $250k if you're caught. Personally it's not a risk I'm willing to take which is why I won't build lasers for others. I've pointed a couple people here and told them exactly why I won'y build one for them.
Sorry to butt in, but I noticed you said, it's not illegal for personal manufacture.
You won't build for others, but Can you point me to the info on how to build my own?

Don't bring back old threads. There is TONS of info on how to build lasers in the stickied threads. If you read more and talked less you wouldn't have this problem.

Somehow I don't think this will help if the shit hits the fan :whistle:


Maybe make it so they have to put at least a piece together(like soldering one wire, etc) ... that way you are not selling a completed laser, just a "kit". Not sure It would remove all liability but at least technically you wouldn't be selling a class IV laser.

One bright day in the middle of the night, two dead boys got in a fight. Back to back they faced one another, pulled out their swords and shot each other. The deaf policeman heard the noise, and came and killed the two dead boys.

It's probably best that someone with your sensitivities takes the initiative and leave. We wouldn't want hurt feelings and all that. Still, the silver lining on this dark cloud is that we won't have more 2-year-old necroposts... well from you anyway.
