just because you apply...it dosnt mean you are going to get it.

there is also a considerable amount of paperwork you have to comply with. Quality assurance, annual reports and tracking of items. It is more than just lights labels and interlocks...it is filing and tracking and verification reports. It is very involved...thats why everyone dosnt do it...they are too lazy. Thats what stops me from selling anything with light coming out the end. I could do it, legally, and have done it, legally in the past...but this market dosnt justify the time to do it legally.

Im not being a legal nanny here but, anyone who sells a device with a beam coming out the end which is not certified and approved is putting their home, cars, toys & ever thing they have ever owned on the line... for others to pop balloons and light matches???it is not worth it.

Well ,

That Dann Hewiit (misspelled for search reasons) guy is the real deal. He is in the FDA directory listed at that number and part of the fda that would try to get intel on high power lasers...

But the fact that he seems to be trying to run his own little black ops missions seems out of line or more rogue than what an organized administration should be doing. I dont know if HIS higher ups would approve of him stepping out of bounds.

just like the other user a little bit ago that got the email from Dann's personal email account , same guy.

If he doesnt get his hands on your package how would he know who your sending to and where they live?

and how can the fda prosecute you if your outside of the US? and if you were to be fined how can they execute the fine?

SkyLasers seems to have an FDA accession number despite having no delayed start (and hell, a delayed start seems to be even more dangerous... all you need is one idiot who doesn't know and your company will get sued).

What would happen if you stated on the site as an agreement of purchase, you understand that the laser is not "complete" and to "complete" it, you must add your own safety features?

Better watch the neighborhood... with Obama anything could happen, we just may see the black suited guys rolling up in drones to take our guns and freedom away anyday now.

Although I have no idea why the food and drug administration would care about this sort of thing, the guys you need to watch out for is the ATF.

Also, the law breaking comes from importing >5mW lasers, not owning them in the USA. So I don't think that you are breaking the law

there is no loophole surrounding the term..."entered into commerce" which is what the law states. If laser kits may and can be completed to an operational condition...the same laws apply.

Trust me, the end of "laser freedom" as enjoyed in the past is rapidly coming to an end. You can thank your friendly aircraft tracking individuals for the hammer that will crack all our skulls.

the FDA sanctions the exploratory use of lasers for specific purposes through a process know as Investigational Device Exemption (IDE).

protective housing
protective housing warning labels
product identification label and certification statement
saftey interlocks
emission indicater
remote interlock connector
key control
beam annuator
specification of control locations
viewing optic limitations
scanning beam safegaurds and
manual reset of beam cutoff

well thats enough to make my butt pucker i am officially outa here

Sorry to hear about this Mohrenberg.

You can consider selling whatever you can legally (lenses, batteries, flashlights, diodes, etc.) and advertise these products with more discretion (rather than "HIGH POWER BURNING LASER DIODE" you can opt for "Replacement diode for Blu-Ray and DVD drives").
If you are really relying on the cash from these lasers, you can sell the complete lasers privately outside of your website.

I would take this seriously, though. There is a lot to risk.

Hey , I think if that if are worried about any legaity at all , then you could do what a lot of other vendors are doing- offer the parts and plans for building! This way , folks that want the lasers can buy OEM (legal) and get expert advice on building. Poeple who are true DYS's dont mind doing some of the work . you can even make an instruction booklet to sell with the kits ( freedom of press , speech , expression , ect) . raise your price a little for the printing of such instuction.
If you are asked for professional assembly, then you can charge for that. Expand your business opportunities !

Diodes are fine, it's only fully assembled lasers the FDA cares about.
