Time will tell - if you respond and it IS a hoax, you just opened up the big box of government gerbils. As a registered Gambling Device Reseller inder the Federal Gambling Devices Act of 1962 (15 U.S.C. 1171-1178) I can say that if this is an authentic inquiry or concern it will be swiftly followed up by personal, verifiable contact (assuming the FDA and the DOJ operate within the same boundaries)...

Personally, if it were me I wouldn't hesitate to take some of the $$$ you've made and invest it in a consultation with an attorney (if you are at all serious about conducting ANY kind of business in the US you should have one on retainer anyhow).

Wow. This is a really tough situation for you. As FrothyChimp and the others said, I think you should first verify the situation and then work it out as easily as possible.
As per getting around it in the future, maybe you can sell just the assembled modules and the hosts separately.
I know it's a tough situation and I wish you the best of luck :)

got this in the mail today from the FDA.... as some of you remember i got a strange phone call a while back which was traced back to dan hewitt from the FDA, and today i recieved this letter.....
i'm off to go read the entire fda regulations on lasers.......


I will assure you that is VERY authentic and you are under the microscope, watch your back...they have your number. Anybody doubt me, I take any bet you are willing to put down, AND LOOSE... ANY BET... and you are probably only the first.

Let's hope they don't do that next, after all unless there FCC type approved, there really not legal in the USA either, and the Federal Gov in the USA could go after them at any given time if they choose to do so. Selling or use of a Non-FCC type approved electronics device is simply Illegal.

Question: since the meters you sell are made in Canada; is it not true that Canada has very similar laws too, for Canadian type acceptance?

Dear Sirs, In reference to your letter dated April 30, 2009 (insert reference number) I hereby agree to cease manufacture any and all laser products or components of laser products. I have removed and wiped my website and promise to never to return until I can completely adhere to the rules and guidelines set forth by the FDA and the NCDRH. I apologize for any inconvenience which I may have caused.

If he sold completed modules, ready to install into a host that he sells separately, would he still have to have the modules registered with the FDA?
I'm fairly certain a completed module does need to be registered.
 
Hmmm, only half the letter on actual government letterhead (and that not confirmed either, is the paper watermarked?) ...

I still smell a rat, Brother...

how many examples would you like me to show you that this correspondence is legit and hasnt changed in over 30 years?

Wow PLEASE don't wipe out your web site, you will be charged with attempting to destroy evidence, that's a Felony in of itself......contact an Attorney ASAP, the letter you received is real.

yep its me...cloaked as a chick that just loves cake!

He must respond to the letter within 30 days, another letter will follow...my response suggested is the shortest path to resolution. There will be a followup letter that will explain the ramifications of neglecting to comply.
 
Looks pretty real to me, but then again i'm not a subject matter expert when it comes to this sort of thing. :confused: Are there anyways to determine if it truly is real? Water mark maybe
