There's been a few recent incidents where people have had their lasers confiscated, so I thought I'd ask this:

If someone tries to take your laser, would you comply? If so, at what point would you hand it over?

I always use lasers in a safe and responsible manner, so it's not too likely that someone would try to take my laser (someone did try once, though). That having been said, whether I would comply would depend on who the person is. If they are just a security guard, then I would not hand it over. Unless said guard is an off-duty police officer, they have no more legal powers than an ordinary citizen. For example, if I am at a venue and security says I am causing trouble, I would opt to leave. But if they try to take my laser by force, then I will respond with force.

With the police, it's different. Without a warrant, police can only seize items if they have probable cause or reasonable suspicion ("in plain view"). The problem is, what constitutes "probable cause" or "reasonable suspicion" is open to interpretation. If police try to take my laser, I would ask them to explicitly state that they have probable cause/reasonable suspicion before handing it over, otherwise they would be lying under oath. Of course if they threaten me with arrest, then I would hand it over (after making sure that they are actually police, of course), no questions asked. After all, I would not want to mess with someone who has a badge and a gun. (True, police cannot legally shoot unless they are in fear for their lives, but who knows if some dumb cop might mistake a laser for a "deadly weapon"?) Plus, going to jail, even for a single night, would probably be a lot more unpleasant than losing an expensive laser, not to mention that I'll probably lose it anyway.

In any case, I would do at least the following three things:

1. Remove the safety key, if it has one
2. Tell them not to point it at other people (this probably won't be necessary if the laser uses a key)
3. Ask to turn it over at the police station, if allowed (this makes it much harder for the officer to pocket it)

Anyways, if someone tries to take your laser, would you hand it over, and if so, when?

Never been there, but I am sure my mind would be blank for a second and if I say something wouldn't be nice more or less like " oj*uiyrpd*2l*4iyf7f9*i2jpd**e5d*md3uiyrpd*2k*4iyf7f9*j7jqd* " LOL

I did have a "security guard" at a convention try to "confiscate" my 5mW green back in 1999-2000 or so. Back then a 5mW green was a huge, huge deal and few people had seen them before.

This was at a (cough) "after-hours abandoned warehouse district gathering", of the sort that was so popular in the late 90s.

I asked him "what gives you the capability to demand my property?"; he answered, "The company who owns this building."

I just walked out without continuing it so I didn't really see how far he'd go, and he didn't come after me.

I'd have to wonder -- how many people *have* had non law-enforcement people attempt to "confiscate" their property?

(I have heard of security guards demanding memory cards out of cameras, too.)

Just would be interesting to see who came across this.

Depends on who it is. If it is a security guard or something then defiantly not. If it I'd an officer then yes I suppose I would. However if you are going out to shine a laser you could just bring a cheap eBay laser along with you and give the officer that instead of a $200+ one.

Of course, I don't use them in "public", but that would be my basic criteria

I was taking pictures around Richmond at one point when a security guard asked me to "hand over my memory card" (side note: I was shooting on 35mm film). After arguing with him for a good ten minutes, I offered to call the police so they could come talk it over with us - knowing that I would win because I was standing on a public sidewalk. To date, he's the only one who's ever taken me up on my offer, and was sorely disappointed when I got to walk away with my film intact. :crackup:

It's a little different in the UK, normal cops don't have guns. If the police did ask I would refuse point blank and demand what law I was breaking and decide from there. I would also ask for a receipt if things got heavy and keep the battery and key. As for security guards they can't confiscate anything off you they have no legal powers to do so. If it was in a club/venue they can only ask you to leave.

Why dont cops have guns in the UK? What if they get attacked by people who have guns and cant defend themselves?

They have armed response cops, only specially trained police can have them, even Tasers the Police have to be trained how to use them and only minimal officers carry them.

If a normal officer sees someone with a gun, they call for the armed response vehicles !!

back in the summer I had drunks try to take my lasers on 2 different occasions;
once while I was actually talking with a Uniformed Cop.
No one got my Lasers, and one guy got a trip to the ER for grabbing my bad arm.

England is actually one of the strictest countries when it comes to gun control. Unfortunately, criminals do not follow the law. :D

I've heard that policeman in England don't use guns because then the "criminals" would feel the need to carry one. Is this true?

I think your slightly off on when they can confiscate your property. I thought they could only do that when they have the power to arrest you? In that case, reasonable suspicion would not allow them to take anything from you. Personally, I would have them state exactly what law I was breaking, if I was threatened with arrest I would probably ask them if I could accompany them to the police station to hand it over. The issue could then easily be resolved with their (arguably) smarter superiors. As for bowing down to someone because they have a gun, if you open carried cops would no longer have that power over you :p
