The charge back would be against PayPal not SciFi. Your call if you want to go that route, personally I would for less than a couple hundred.

An account could be terminated if you file a claim against PayPal itself though which is what some are considering.

Then perhaps the sequence of events should be:

1. File with Paypal first. If SciFi doesn't respond to claim in 10 days, you get your money back. If they don't do that, then....

2. Do a charge-back with your credit card company. But if PP has already denied claim (on whatever basis), is this idea still possible?

That's exactly what I intend to do. I'm giving paypal the chance to make this situation right before I consider other options. It's a pretty clear cut case of the seller not sending the item.

In my case it may not be as clear cut. I actually received the item I ordered, but it stopped working after 10 days. I specified that in my claim. I wrote to SciFi asking for a refund, a replacement, or a fix. I got no reply. There is a 6 month warranty, which I'm glad I had the idea to make a screenshot of before his site was taken down, but that's not being honored.

I understand that part, but I was responding to where people were talking about legal problems we could get into if Eitan handed over our personal data, or if Paypal decided not to pay us back because they were "prohibited" items.

Owning/buying lasers not regulated by the FDA can't get you into legal trouble.

Selling them on the other hand...

Unfortunately its not. PayPal's only obligation was to transfer funds you sent to them, to SciFi. Which they did.

There's no guarantee that a charge back against PayPal would be done. Worth a shot in your case, but idk that it would work. You can bet PayPal probably has their end covered with some disclaimer somewhere to prevent this exactly.:undecided:

Don't take this wrong joker, but if you really want change, do so. Stop taking orders from now, finish the ones you still have, get you stuff together and start over. Raise the prices a bit. Sure, you will get less orders, but that's what went wrong in the first place isn't it? Fix the tracking issues. Make sure you are able to complete an order in the time you have said you would complete it. I truly hope all this gets resolved, because it would be a shame to see such high quality lasers not been sold anymore.

Also, everyone that has made their order, I truly hope for you that you will still get your laser or money back.

I'm out $250 as well. Several wrong tracking numbers and many "you'll get it soon" and "will email you in the morning" responses. I opened a claim and dispute on the 16'th so we'll see what happens. I was at day 58 or so when I opened it.

Just from my experience, I found this site and other than a couple cheap ebay pens I didn't have any lasers. I purchased from Sci-Fi back in mid Feb. due to them being cheap and having a somewhat good reputation at that point. Also the sponsor banner helped sway me as well. Luckily I'm not out as much as other people but I hope all those who are out money get refunds.
