I just got an email back from the police! Ooops... shouldn't of been so 'uncooperative' I think...

Anyway, here's the response:

Mr WATTS,

In relation to your emails to this office.

Firstly as you would appreciate we receive a large volume of correspondence and most of it actually contains contact details of the author, especially when they expect a response from this office. I managed to find your previous email which seems to have been sent through in such a haste there was no contact details attached to it.

Furthermore as your email was received prior to the notification of the Act, this office was not in a position to advise the community in relation to what would be required and to whom the exemptions would apply.

As the notifiable instrument has now been signed and placed before the ACT Parliament and the declaration states that a person is able to possess and use a laser pointer if the possession or use is reasonably necessary in all the circumstances for the lawful pursuit of the person's occupation, education, training or hobby.

From your previous emails you state that you possess a 290mW 650nm you built yourself. Also a 70mW 405nm and a 500mW 532nm laser, all are portable lasers.

As you can see from the above reproduction of the declaration possession or use must be reasonably necessary in all the circumstances and lawful. You have not provided any information that would allow me to make an informed decision as to whether to allow you to possess lasers which clearly exceed the 1mW limit imposed by the ACT Government.

Should you be serious in your enquiry with this office in wanting to obtain a permit to possess lasers which can clearly cause damage to persons and property, I will require more information from you.


If you seek a permit, I will require you to arrange an appointment to attend this office and discuss the matter with either myself or my staff.

Note that I said I built my 290mW, to sort of imply that 'stopping me from importing won't stop me building'. But of course jayrob is the true builder of that laser :)


What do you guys think my next move should be? I can either keep going, in the face of that discouraging email and potentially have all my lasers confiscated. Or I can bail.

Oh dear god.

I'm going to regret this I just know it, but I'm going to keep jumping through those hoops. I'm not too worried about the imports permit anymore, since I'll probably sell off the RPL-400 anyway due to the unexpected need to export it for repairs.

Instead I just want to try for the possessions permit, and see if it is possible. I stand to lose $1500 worth of lasers... crap. Oh well... we'll never know if we don't try...

*deep breath*

I'll email back explaining exactly what the situation is, no lies or sugar coating anything. I'll also ask what happens to all my lasers if I fail the possession permit.

Wish me luck... dead man walking...
 
Yeah, I'll need to do a bit of sugar coating methinks. But still, with utmost honesty.
 
Murudai, how about you send your most expensive laser to somebody to hold when you go through the hoops? It may be illegal to IMPORT, but as far as I know, you can still ship them around AU 8-)
 
Nope, it's illegal to possess them as well :)

But the thing is, you need a possession permit in order to get an imports permit.

Is that only for ACT and NSW or all of Australia?
