Custom Lasers to the US?

Hey
I thought, only laser POINTERS are illegal in the US now. Concealble and so on.
But what about a lets say Halo themed lasergun? Would that count as a prototype? Would that FDA form help to get it through?
The form itself is a challenge for me (a German dude), with all the lawyer-english terms. Lil help?

I would just claim it has a videogame prop or something. If it doesn't directly look like a laser, don't say its a laser :D

As crazy said, just name it as a prop. You don't want to get yourself into more trouble then you need to :)

To in the US, the legal limit is <5mW or Class IIIa if it is being labeled as a laser pointer, handheld laser or anything which could be used in a non laboratory/experiment setting. Lab lasers which generally have power outputs of over 5mW are allowed as these require an outlet and aren't used as pointing lasers.

If your flying here and its checked luggage, and its returning with you, it is less of an issue.

If you are shipping it here....

Prototypes when they come in have to leave within an agreed time period or be destroyed. And periodic checks are made when declared as a prototype, once its in the states. Your customer faces a serious issue if it does not leave or is not destroyed.

Either it is an approved device with a an approved variance, with the variance number label on the product, as well as an having an assigned accession number or bonded as a engineering sample, or it is not legal for import...

If it has no laser in it, its just a toy gun... Some states such as NY, NJ, CA, VA, MASS, and the Transportation Security Administration have laws/rules regarding realistic looking toy guns as well...

You either go thru the full procedure, or remove the laser(s), or your breaking the law and its subject to seizure...

The variance form is not that hard, but you will have to add certain safety features and your customer will need their own variance, prior to purchase.... Which I really wonder if it would be issued at all, unless the customer is a laser show company, professional entertainer, or a movie studio.

One way or another it is considered a Demonstration Laser Device (Old name for pointer)and perhaps not a legal one...

No guys, its not that easy. I do call it PROP because they ARE props.
Halo rifle, BUT they seem to xray everything now! Then the FDA takes it,
client has to go there and they fine him -.-

Thats why I was opening this very thread :) if it was that simple, I wont even bother you guys ^^

I know a fair amount of people who fly internationally and the have had no problems with class III and class IV lasers as long as there are no batteries in the baggage and it is in the checked luggage. It cannot go in the carry on, it must go in the checked luggage. Good luck!!

A LETTER CAME IN TODAY! Customs and border protection.
My english is not bad, but all the § and ? are out of reach for me in
a certain way. I am not a lawyer, just a toymaker.

I never include any batteries, I never sell anything to kids under 18 or
obviously stupid people. Have to admit I cant wait to find out what happens xD
The land of the free, where you can buy drugs, guns, cannons, 1000HP cars but LASERS ARE BAD!!! BAD!!
