You can consider selling whatever you can legally (lenses, batteries, flashlights, diodes, etc.) and advertise these products with more discretion (rather than "HIGH POWER BURNING LASER DIODE" you can opt for "Replacement diode for Blu-Ray and DVD drives").
If you are really relying on the cash from these lasers, you can sell the complete lasers privately outside of your website.

I would take this seriously, though. There is a lot to risk.

Diodes are fine, it's only fully assembled lasers the FDA cares about.
Yes, I know this, I'm just suggesting that he continue to sell the legal stuff on his site and keep the fully assembled lasers for sale privately and discretely.

wrong, kits are included...the key is to sell the kits without the diode or sled, you could provide a list of vendors who sell diodes and sleds. you sell everything else. Then it is a real DIY project anyway.

!
What is it that makes a laser diode illegal?
Alone, it is just a little sliver of metal with a semiconductor attached.
Does this make other Class IIIb - IV laser devices and components (Lab lasers, diode bars, & gas tubes) prohibited from being "entered into commerce?" Do these individual components require FDA approval?

If that's how the FDA regulates these items, then there are dozens, if not hundreds, of businesses that violate these laws every day.

Thats a shame man, I can understand why you had to close the site though. Personally I would shit my self lol, it's really not worth the risk of getting fined/prison, but as said before you can always sell things just not actuall fully assembled lasers and just keep those for private sales :)

the ability to turn it on.. You can not turn it on unless it is installed in a certified / approved enclosure meeting the criteria. Even an OEM argon laser can be sold to OEM distributors, but they can not be "entered into commerce" until the OEM module (kit) is installed into a certified / approved "system" and the paperwork trail started The components are not individually certified, only "when assembled" and "entered into commerce" are they required to meet guidelines. A hobbyist can do anything he wants...except sell.

NO reputable laser manufacturer is breaking any laws. Name one (excluding imports). Components are components and are handled differently than operating systems.

Private sale??? dont bet your lively hood on it, all it takes is one kid with a dad who is a lawyer when the kid looks into the end and pushes the button to be moving into your house and moving your ass out.

There may be violators...that just means they havent been caught yet. (importers).

Who says that the laser kit is supposed to be over 5mW? Just prepare it as a 5mW pointer and provide a disclaimer stating that you are not responsible for any attempts to modify this laser.

Re: Closed - FDA is checking on me!

Hey buddy if you are so negative about the idea of poeple being able to build little weak tape burning lasers , then why are you on the forum? If you are not part of the solution , then you are part of the problem !

Re: Closed - FDA is checking on me!

that might work, but if you provide any information on how to "modify" it...you would be treading on quicksand. You might be able to claim the "twinkie defense"...it worked for one individual.

Optotronics??? I said one reputable company...they are not reputable if they are selling illegal laser pointers.

They have a very good reputation though, I think that qualifies them as reputable.

OOOOOkkkkkk...where to begin with you??? Check my resume first then you may speak "at me". I have NOTHING against you building ANY POWER laser you desire, in fact...I help you by supplying you tools to accomplish your "dreams" (have you checked my website) But as a home owner, I choose not to loose my home or spend any prison time with Bruce (because that would be streaching a tiny thing a long way). I am on this forum to learn about this new technology and to teach others a few other technologies. I have been part of the solution for around 35 years. I dont care what you do, im just telling what and why you are not supposed to do it.

their reputation to successfully sell you an item has nothing to do with the item being legal. I have known MANY very dependable drug dealers over the years and they have always delivered but that dosnt make them reputable.
