Who covers lost package?

I ship anything of value with confirmation. The only excepting is international in which case confirmation is not possible or very expensive. In these cases I explain to the buyer that I am willing to ship the item international but if it is lost or confiscated that I will not refund. I give them the option to back out so that the liability is off of me and it is their decision to buy under these terms. I also have the email correspondence as evidence to these agreed terms. I dont like to ship international for this reason but this method hasnt failed me yet and the items have always arrived.

Without such terms it really is the sellers responsibility as for all the buyer knows you never shipped it or you wrote the wrong address etc. You also chose and arranged the shipping service and opted out of confirmation. 80 cent mistake turned into a $200+ mistake. I bet you wont make the same mistake twice.

I have asked paypal about this and they told me that I can not have a contract with someone that overrides Paypal's policy. Getting them to agree to it may lessen the possibility of them filing a claim against you but paypal will still side with them even if you show proof they agreed that lost or confiscated packages are their responsibility. If you can not provide proof of delivery you loose.:undecided:

There is no trick about it in how I present or describe the arrangement but I guess many people will be happy to forget if the package is lost. I am considering never shipping international anymore which is too bad but how else can it be done safely without charging huge delivery fees? Last time I mailed internationally it was $5 shipped which seemed like a crazy good deal or $26 with confirmation which is less than good for as small of an item as it was.

Like I said the only problems I have really had with first class and priority international is slow shipping but they always seem to arrive.:scowl: I tell people to expect 10-30 days with first class and priority.

Express is $27.55 for a legal flat rate envelope and you would be surprised what you can fit in the legal envelope with a lot of tape and bubble wrap to give the package some durability.:eg:

If the buyer agrees to the "conditions" Helios described, couldn't the seller have the buyer send PP as personal payment so it can't be disputed.

I know this is against the rules but... Just thinking out loud.

I haven't sold that many lasers, but sold a few. Basically, I think it's up to the buyer. If they send it as a gift, I'm 100% ok them sending 3% less, but I don't feel right even suggesting it...

If the buyer presents the option, fine.. but as a seller I don't think it should be offered.

That said.. I do send payment sometimes as gifts, to people I trust 100%. I also realize that shit comes up in life... so que sera, sera

its upsetting that even at the persistence of the buyer you cant work out a legal written contract where the buyer assumes legal liability knowingly and legally. Damn internetz

Accepting payments as gift is risky if you need your paypal account for your business. I pay people that I trust as gift always as well. Every once in a while I get an email from paypal asking me if the payment was for goods or personal. I always say personal but if you accept a payment from someone as gift and they say it was for goods paypal can suspend your account or charge you back fees on every gift payment you have received. If you are just an occasional buyer/seller I guess you can take the risk but if it effectively will shut your business down it is not worth the risk. See this thread of mine.

I'm used to taking responsibility for shipping, even international. Every package always arrived, the one time it didn't the seller disappeared, so that one obvisouly didn't even get shipped. But he also didn't respond to the paypal dispute, so that was an easy win.
