Paypal's buyer protection fails

i thought they protect customers who buy stuff through paypal.
Well lasever a company i did business with just upgraded my dispute into a claim and i got a email that paypal doesnt get into this stuff usally with a link to some kind of article.

I guess only purchases through ebay are protected now, the rest is not anymore.

Im going to transfer every purchase through gift the next time.

i lost 760 dollar now.

BTW... I've never had a problem with Dispute/Claims whether
I bought an item through eBay or off a non-eBay website...

I never send PayPal payments for items as a GIFT...:eek:

But I guess that's just me...:whistle:

$760 is a tough pill to swallow, I wouldn't be giving up at all.

PayPal locked my old account with 800$ in it.... Trust me I tried the best I could to get it back... Provided all the stupid shit they wanted including passport, Medicare card, drivers license & they in the end thought I was a scammer... Closed my account permanently & I can't get back any of it... PayPal sucks in my opinion but it's also the most used payment method online, not accepting it as a seller can drastically reduce sales... It really sucks, I tried filing a complaint with the BBB & PayPal still refused to open my account, I gave up eventually :(

But losing 760$ is horrible aswell, don't give up, call PayPal also, ( although in my experience it's completely unseless ) but for a buyer they will likely help you...
 
the basis of my situation: transferred money as goods. goods are 700-800mw but not 1200mW what i payed for. Seller says need to increase voltage. driver burns. payed for new psu and driver. psu is nothing new and not the voltage where i payed for. driver burns again.
sending >30 mails back and forth.
making paypal dispute. seller upgrades to claim. Within 30 seconds claim closed and paypal says its not purchased on 3 "protected sites" so i do not have rights on buyers protection.

Jerry youre such an idiot. i can transfer as gift because paypal closes down any claim anyway if its not a deal on ebay or 2 other sites paypal "protects".
Why transfer as goods if i dont have protection anyway. I dont want paypal to have some bucks over a protection they dont give.

If you transfer something as a gift, you have zero recourse in any situation. The person can just take the money and send nothing in return, whereas if it's a "goods" transfer at least if nothing was sent you can claim the package never arrived and get your money back if they can provide no proof to the contrary. As for products being within certain specs, Paypal can't verify anything like that, nor are there any terms of contract ("not DOA" or even claimed specs) such as you'd see in an ebay auction.

Finally, you're being penny-wise but pound-foolish. Rather than give Paypal a cut, you're giving $760 or whatever you might send in a future sale, to someone else, and gaining nothing in return. Losing 4.2% versus 100%. Think a moment on that.

If you buy something with PayPal as GOODS... it's NOT the Buyer
but the Seller that gets charged the PP fees...

I guess it STILL hasn't sunk into his thick head yet that
you DON'T send PP payments as a GIFT...

The seller has its fees counted on those paypal goods sales. Or transfer and gift and the selker can lower his price.
I do not see any reason to go purchase as goods anymore. A seller can send a brick or empty package and hes done.
I have proof about the laser module not doing as it should. 3 vids and 3 photos. They dont even want to look into it.

Shipping nothing or a box with nothing is desame to me.
Cant trust anything or anyone anymore. Kiyoukan, then paypal.
 
Buying as goods with PayPal is OK. Transferring as a gift is an invitation to get nothing in return.

In the case of goods where you receive nothing---you make a claim and get you money back if it can not be proved that something was delivered to you.

How can PayPal ever get involved in specifications dispute--they have now way of knowing anything about what you bought other than something for a price that was delivered as far as the seller is concerned.

Sounds like as disconnect between you and the seller--if you had just returned the underspec. item in the conditioned received to the seller to exchange for a up to spec example everything would have been OK -right?

its not that easy. i gave a quick explanation.
The seller still thinks its my fault.
After i received the 5v laser it was below spec. seller said oh wait it needs 6v....i could put it on 5.5V and voilla the driver burned. second the seller send me a 6V Psu and a new driver. well the new psu got me 5.5V and the driver burned by it.
They ask if i didnt drop solder in the psu or driver because it cant burn like that.... yeah right 2 times same driver same spot same smoke.

i payed for 2x600mW lasers combined by PBS. so that can be shown in video with a laserhead showing it does not give 2x 600mW.

Unfortunately it is a issue between you and the seller over product product bought, product received and product damaged while in your hands.

All you can do is try to work it out with the seller---send them your video with a point by point explaination and tell them you want to return the pieces so they can see for themselves and sort it out. If they repeat what you did and get them same result---then maybe they will get the proper unit to you or get it properly repaired/modified after seeing that you received an incorrect item or whatever the case is.

Perhaps as a last resort, you could post a review of the transaction in the "companies" section and maybe if we all join in, it would create enough pressure on Laserver and compensate you with something.

AnthoT, really sorry to hear your terrible experience with PP. I'm curious why in the first place they locked you out of the account. There should be absolutely no reason why they're steal your $800.

-send PP money as gift= no buyer protection. easiest way to get scammed as the seller may not even ship the goods.
-send PP money as goods= buyer protection. example: it was that time when kiyoukan disappeared for the first time. I never got my tecs and heatsinks. fired a dispute. got my money back because it was within 45 days after PP was sent.
There are exceptions though but sending the money as goods is the only chance you have to get your money back in the case of a possible scam Not sure about Borg's situation but if you claim that you never got your goods you have a better chance of winning the dispute.

That's the point... The Queen did receive it. And by pi$$ing the
seller off by opening a dispute rather than working it out with the
seller the buyer shot himself in the foot.
As stated above the seller had already made an effort to make things right..

Perhaps it is operator error. I can't understand why standard
equipment that runs on 5Volts for everyone else needs to run
at 6 Volts just for this buyer...:thinking:

Exactly lasersbee--pretty much my thinking also.

The only recourse is to go back to the seller and hope they have a sense of humor and make another attempt by allowing it to be returned and have it repaired to put it right in the interests of happy customer, better/more business.

If the seller was Lasever, David Wu is known to be an OK guy who has help out many people who have had problems---approach him and see if you can return the stuff for test, evaluation, and repair--you did invest the money with them and they should give you service on the product---if they told you to put 6V on it and 5.5V ruined it then include copies of that communication with the return
