Liability of selling a laser on here

I'm considering selling my BR 245mW which darkarmyofone built for me, its not that I don't like it but I had a close call with my eye, my friend pointed it at me accidentally, and hit my eye, I think it was my eyelid though because I don't have a blind spot, I just had a purple afterimage when I would blink for an hour or so and hopefully no damage was done... Anyways if I'm going to sell my laser pointer is there any liability that I would have to worry about, like someone doing the same thing and blinding someone, or pointing it at an airplane? Would they go after the user not the seller in the rare case that this happens..

this is bad and not so bad . "not so bad" is you should realize that a bluray over 5 mw should be treated like a gun very dangerous -possibly a lesson learned if your not hurt
Bad because you may have damaged that eye of yours and may not see it for awhile
please use ppe personal protective equipment whenever possible

edit most of my friends don't really understand the dangers and theres no way I would let them hopld or use one of my 100mw+ units around my eyes or thiers unless protected

i usually light a flashpaper and they wont even ask to use it after that

That's just a rule that all my friends respect..

Hopefully you won't have any permanent damage because you
wanted to be cool and let your buddy play with your stuff....

Yeah it serves a good lesson, I understand that I don't think my friend did... Which is why I'm either going to buy googles/glasses or sell the thing.

Why would it take a while to notice the damage?

i'd first make sure your dumbass friend understands what he did.. accident or not, he should have been much more careful and respectful of YOUR laser.

when owning a laser, i would treat it pretty much as a gun.. it is not a toy of any sort..
though (like a gun), you can have some fun with it under controlled conditions.

(for a gun, shooting range, and necessary hearing protection.. for a laser, proper protective equipment.. etc.. etc..)

no different... and as far as liability... it goes to the owner.
if you sell the laser, the new owner assumes responsibility for its safe use.

pretty much... the only thing the seller needs to worry about.. is selling a working item... and making sure that the owner realizes that it is their responsibility of its use prior to the sale... which should cut out your liability of it being used improperly.

then also, it would be wise to make sure the person you are selling it to.. does not intend on using it in an irresponsible manner.

If I got rid of it, it would be around $220 Shipped with Trustfire Charger, 3 Batteries, two GITD caps, and 2 marbles, and hopefully the buyer will buy a pair of safety goggles...

Dark is selling them for $250, without the charger and extra batteries. Its in a Pallide host if I didn't mention it already, and its a 6x diode with 405-G1 lens. It's a work of art though, he does really awesome builds...

First of all as John and others have mentioned, treat all high-powered lasers like you would a gun. Secondly, I hope you are all right and have no lasting damage. But since it is so powerful, it is nearly worthless. I'll take it off your hands for $10.00. Just PM me and I'll give you my paypal account info, so that you can send me the money. I can then safely take that out of your hands and help it to find a good home. J/K

i see nobody has addressed you liability issue. in the society we live in there is always a posibility for a law suit to come against you. whether it has merrit that is up to the courts. if you really are worried about it consult a lawyer. also don't sell it to a noob. (sorry noobs)

I agree - there is always the possibility for litigation, no matter what you're selling (which is unfortunate). The trouble here is any laser over 5mW is an FDA-regulated product and you technically could be found liable for damages it causes. My guess (purely speculative) would be that anyone would be hard pressed to successfully sue you if you included quality, tested and certified eye-protection as well as a disclaimer with the laser (better yet if you could have them sign a waiver prior to the actual transfer of $ or ownership)

err...you could have gotten an IgorT laser for that. I believe Igor does make people sign a waiver before he ships the laser. So it might a good idea to do the same.

IgorT's are only 150mW, I was going to buy one from him, but he never got back to me. Thats a good idea though, if I was to sell it I would make sure to include a disclaimer, safety sheet including the possible hazards and probably some sort of signature saying that I'm not responsible if anything were to happen.

As far as my eye goes, I've been pretty freaked out the past couple of days trying to "see" if I can notice any damage from the laser, which I probably wouldn't be able to notice at first anyway? But haven't been able to really notice anything to out of the ordinary, I was reading that your vision would be blurred, notice afterimages, etc. I think my eyes were closed, so I may have gotten lucky, but I will never let my friends touch my laser again and will wear some sort of eye protection from now on...

also since you are looking so hard to find laser damage. you are more than likely to see "floaters". they are small black specks that are seen when you look at a light colored back ground. this is not laser damage. it is loose eye tisue that has made its way into your field of vision. but if you do have that now and have never noticed it before, go see an eye doctor to confirm.
