CNI's pointers should have a labeling showing their max output is <5mW's even though the peak power may at times exceed that FDA limit.
CNI won't send anything your way over 5mW's unless you have a specific need for it(and proper documentation) or if you are getting a laser which isn't a pointer/handheld format.
I'm sure CNI made sure to make sure the labels read <5mW's. Remember that CNI is under the FDA watch list, I'm sure their just making sure everything is well &I will send them on their way
