Its often difficult to get it exactly right, but 42 vs 45 is a very minor drop - could be coincidence really.
As for reselling these lasers: the beam grazing the aperture would be a big problem, but i suppose most of the units will not have this problem.
If you mark them as 40 mW units and check before shipping them out, i'd think its all fine and good. Obviously they should be powered with 3.6 rechargeables instead of 3 volt primaries, but that can make a decent package deal.
One thing to test for is how long they will run on 3.6 volts though... i've seen lasers like this one survive for ages at elevated supply voltage, but it would be very bad if all your customers came complaining about broken units within the year.
