Hey

my friend thinks he just got scammed. He bought something from someone, payed via paypal (nothing to do with ebay or anything, it was off a forum I believe) and this person has not posted the item, has cut off all contact, except saying "thanks, you just earned me a new bike", meaning they have cleared the paypal already. will my friend get his money back? i know alot of you lpf members deal with paypal everyday, im hoping you can help us out here

It all depends if he is covered by PayPal Buyer protection...
If he is... he needs to open a PayPal Claim... and win the Claim...
(he will win if the Buyer doesn't have Proof of Delivery)...
then PayPal will try to get the money back for you from the
buyer's account.
If the buyer doesn't have the money in his account then PayPal
will wait until there is and refund you then..:cool:

File a dispute with Paypal as Jerry said. Unless it was something wierd like the payment was classified as for a "service" or "non-tangible good" like software, etc, he should have a good case. If the payment was marked as something that didn't require shipment, then you may have more trouble.

Also, if the payment was made via a credit card withdrawal (through Paypal), then you may also be able to file a dispute with your credit card company for the transaction. But, I would attempt the dispute process through Paypal first.

Apparently hes made a dispute, and he wrote it was for what he was purchasing.

So if the guy has no money in his account will my friend get anything back from paypal?
 
From what I know, PayPal gives them a negative balance and refunds the money to you..

Not True....

If there is no money in the seller's account... PayPal will continue
to check when the money is available to refund you....

But they WILL NOT give you a refund out of their own pocket....

It was either money owed to PayPal directly (fees..whatever)... not to a customer...

OR

There were so many customer Claims that he lost or were pending and that was the
amount that PayPal was looking for to pay back to any Claim seeking/winning customers.

OR

A combination of the two.............

I don't have BF's PayPal files to refer to.... so I can't be 100% sure in his case....

Once a PayPal buyer Claim is filed... that amount of money is frozen in a Seller's account
until that Claim is settled...
If the money is not in the Seller's account a Negative amount would show until that Claim
is settled...

Either way.... PayPal WILL NOT pay a Claim out of their own pockets...:cool:

100% true.

But don't forget it's imposible to have 2 working accounts on paypal without them knowing it's you. So if he just leaves his paypal account empty, or he doesnt touch it anymore or he will have to money withdrawed as soon as he puts enough cash on it.

If he buys the dispute he's most likely going to get the money back :P

It is possible to have two working accounts. Just use a variation of your name. I got one paypal account suspended for selling on ebay, and I made another one one week later. It still has not been suspended, or investigated, or whatever... The guy is not going to put money back in his account... It would be a stupid thing to do... You better hope that that guy had some money in his account and it got frozen... Otherwise you're out of luck :P
 
If he was scamming, then it is likely he withdrew the funds from his account already and won't replace them either. I suggest your friend calls Paypal about it and explain the situation and see what they can suggest. And, be very courteous about it too, as it's not their fault he was scammed; being nice about it will go much farther than being aggressive or angry on the phone. If that first person can't help, you can always call again to get someone different or ask if you can speak to a manager.

Also, like I mentioned, if your friend used a credit card as their payment source, your last resort may be disputing the transaction with the credit card company. In that case, they reverse the payment made to Paypal and then Paypal will trickle down the charge to the person's account, which will likely end up being submitted to a collection agency and hopefully damage that persons credit history for being such an a$#hole. But, you should ask someone at Paypal to make sure it won't negatively impact your friend's account either.

For a working account I mean a vinculated account. unless you make a false identity to open a bank account paypal will still know who you are.
 
Doing a chargback on a credit card---Through the card company--- that was used to pay through paypal will result in you getting banned....paypal doesn't like having "their" money taken back by the CC card company. Just FYI

What does vinculated mean? I tried looking it up but didn't get any info... Also: I am not using a false identity. Just a variation of my name-- like a nickname? As long as your last name matches, you can add a bank account , etc
