Is it illegal just to import or to have






I PERSONALLY think (and I know this will piss a lot of you off) that there is absolutely no need for a battery powered laser over 5mW. I also don't think there should be ANY pointers that do over 5mW WITHOUT the proper safety equipment built in. They really cause more trouble than they are worth. The reason they are restricted to 5mW is because you cant really do anything with them that necessitates more than 5mW. AND, if you do have a legitimate need for a portable higher power laser, there is no application in which the safety features will interfere.

So if you are upset about importing high power lasers, just get one that has been accessioned by the FDA and your troubles are over. They really don't make it that hard. Aperture cover, interlock, keyswitch, delay, and emission light. I don't think it's too much to ask for.

Would you want to own a gun without a safety? ;)

Just my personal opinion. I have and have had pointers stronger than 5mW, but as a general rule it's how I feel.

Kid, you have no clue about gun ownership laws and rules.  :P  Don't mean to be harsh but do some research before you write how you think it's so easy to buy a handgun.

To buy a handgun in my state of CA you must first be at least 21. You must get a handgun safety permit. Next, you may go to the gunstore and buy a gun but first you have a 10 day waiting period and must pass a background check. The handgun must be registered and your name is nationally registered to the gun with it's serial number. Be prepared to have your driver's license and proof of vehicle registration ready.

Selling a gun to a private party without going though an FFL (Federally Licensed Firearm Dealer) is a felony.

There are only book restrictions on lasers. The police do not care, as long as you don't bother anyone or point your lasers at people, cars, or planes. The only people in trouble with police that I know of are the idiots who pointed lasers at planes or at the police or moving cars!  >:(

FrothyChimp wins this one. Gun ownership is a constitutional right, owning lasers is not, period.

As to gooey's comments I think hobbyists should be allowed to own highpowered lasers but I'm extremely biased on the topic.
 
yes i do understand the laws of gun ownership and or purchase. That part was sarcasm. In Washington they do felony back ground checks, etc. My point is that with proper permits, and other regulations you can own a firearm, carry it in public and if and when you decide go practice, hunting and nobody is treating you like you have any criminal intent. Of course with most regulations on firearms they make complete sense. They have tightened up on hand gun laws with respect as they are the most common involved in crimes.

Lets use hunting as an example. There are restrictions on the power/caliber for certain game. You can not by law hunt big game with something like a 22 caliber primarily because of the greater chance of just wounding animals. So now lets look at it in a hot rodders sense. Were just trying to get the motor tuned and bring on some more horse power. It doesnt mean that we are going to be racing up and down the streets.

I am not arguing the chimps position as to what the legality is only my/our rights as citizens of this nation. I can go down and buy a 7mm rifle that would kill at a thousand yards but will be given hell for having a 5.6mm diode in play. As i stated this is for a hobby. All i am wanting to do is burn some tape, light a few matches and pop some balloons as with others on this forum. I have no interest in building any super laser for lasing a plane in half or blinding a pilot. I think that if a terrorist or anybody with criminal intent really wanted components for negative reasons they would be looking for items much greater than ours and they would get them.

Hell, at least just give us a chance. Run a felony background check on us and if we pass at least let us play with something up to around 350mw. For the ones who violate safety laws throw their asses in jail.

Yes i do understand that we are dealing with over 300 million people in the USA. If we did the math there would be an extreemly small percentage of them who are dealing with high power lasers and if we broke it down further as to the legal complaints goverened it would be even less. Do the same with guns
 
So... can anybody sell <5mW green lasers like they do with the red ones or do you have to have a licence or make buyers sign a waiver?
 
Do not bump dead threads.. Did you see any word about colors? It's the power which matters, so yes, you can sell the ones under 5mW no matter if they are green, red or pink :crackup:
 
You've read the FDA warning on importation and so have I. The FDA makes it very clear that importing a laser pointer over 5mw is against federal law. Frankly it's written in plain language. Selling a laser pointer is also a no no. Buying a >5mw pointer is not unless the law has changed

Recieving it from a company is perfectly legal even if it does not meet FDA requirements or 1 million watts. For the buyer for personal non commercial use. But it is Illegal for the company. I just looked it up because I was worried that the Feds might arrest me when signing for a package. As long as your not a company selling completed lasers.

If there not supposed to be used why don't they get deleted. I use the search when looking for relevant information. It doesn't matter to me or anyone else, if it is the information that they are looking for how old it is. Why does it matter?
