a damaged goggle from ebay seller

I purchased a safety goggle for Red and IR wavelengths from a famous ebay seller, zone2stealth. Unfortunately, it arrived broken frames around blue filter glases at many points from both sides because it was not well packed. I sent the pictures to the seller, he told me he can send new one if I sent it back to him. I asked him also for return shipment, at the beginning he said that it might be free, but after a few email between us he started to tell me that I have to pay this shipping cost, which costs 15.5$ a registered one from Italy to Hong Kong. It is a quite high cost for me. I complain about this to seller because basically this is his mistake sending the goggle without an enough protection.

I checked the internet, but I could not find a clear thing who takes responsibility about damaged arrives on Ebay. Do you have any experience and suggestion for me? Thanks...

Update info for final situation: After open the return claim and discuss in there, the seller offer me a full refund and asked photo of fully smashed goggle which done by me, so nothing needs to be return.

They could tell you to file a claim with the shipping company, how much did the goggles cost? Was shipping insured?

RedCowboy, thank you for reply. I paid 41$ for goggle and 2$ for shipping. I do not have insurance, i just figure out insurance option. Maybe seller has. Now seller is quite silence, does not reply my last two emails, yet.

the seller is zone2stealth, he is a known seller even in this forum.

Survivallaser does not have a safety goggle to cover together red and ir range up to 1100nm and shipping cost to Europe :(. This goggle which I purchased is also an eagle pair EP-14.

If that's what you used, yes. It's a very straightforward case. Only issues is you may be asked to ship the broken goggles back, which with tracking could end up being expensive.

If it is ebay then just start a return saying received damaged item and the seller will have to cover return shipping. You will receive a prepaid shipping label or the seller can choose to refund you and let you keep the product.:)

With international sellers, it's usually easier for them to just refund, though they may ask for pictures as proof. If the seller just doesn't respond, as sometimes happens, then paypal will refund you.
 
Ebay policy changes, used to be if he package was damaged you had to deal with the shipper, but if DTR says click the start return them go for it

With Chinese sellers I could send a pic of a working but dim dpss laser and they would send me a new one no questions asked, but if the package or unit was damaged it was a shipping issue, now maybe that has changed.

I assume something like that but when you check it there is no a clear statement on the webpage of Ebay. This is a bit outward.:undecided:

I would suggest doing the ebay return first as paypal will have you send the item back at your expense where eBay policy as of the beginning of this year is the seller covers for damaged or item not as described return shipping. Ebay will supply you with a label and deduct it from the sellers account unless the seller chooses to just let you keep the item and have a full refund.:beer:
