seriously, if the seal surface is decent, w/ a bit of swimming pool O-ring silicone you can get a pretty good seal on things...

I'm a bit confused by the waterproof part, can you use it under water? Also, how deep can this go (when it's off) without leaking?

How deep it can go without leaking depends of how well the o-rings fit and how well they are greased.
Whether it will work under water will depend on the pressure on the switch.
Assuming it is a standard tail-clicky there is a rather large area for the water pressure to push on, which have to be countered by the clicky spring.
At some debt the water will simply push it all the way in leaving it off.
