The problem en lies in the legality of you possessing the laser in the first place, depending on your country (usa?). Even if it is illegal for you to have the laser, it doesn't me he can just do that, but it may create a sticky situation for yourself that may end in getting your laser confiscated.

yeah, that's a 'problem' with a justice system when it works right: it's blind, or rather it's even-sighted and everyone involved should be treated according to the laws in effect. But it may be worth sacrificing a toy, a cheap price really to get a potential bully off the streets!

complain then get the officers name it possible and pursit it till you feel satisfied. just because he is a police officer doesn't let him be a f****ing bully. if he is willing to endanger a 15yr old for a minor accident a possibly cause blindness wat else has he done? ask your friends to help you compile an accurate description of the police officer and take it to te police station. see if you can spot the officer in the office, apologies to the *eye doctor* and tell him/ her what happened he/she may help you.

So I was playing around with my 30mW green, and apparently, I shined the laser "near" someone, and they said it got into their eye(It was on the ground near them, I was like 200 ft away too.

isnt anyone going to ask the obvious ?

I see some problems here.
1-It is illegal to own the 30mw pointer in the first place. In order to be fully legal in the US lasers over 5mw need safety features like those on the laserglow lasers.
2-I think it's against the law for minors under 18 to have control of any >5mw laser.
3-Technically you need to get some kind of permit from the government if you want to use a >5mw laser outside. This one is especially stupid because they would be swamped with applications if people applied for one any time they wanted to have some fun with their laser outside at night. This regulation was probably made with large lasershows in mind because they don't want people randomly shooting multi-watt green lasers into the sky.

Normally these ridiculous regulations are rarely/never enforced, but if you try to sue the police they can easily bring these technicalities up and spoil your case. It might be better to forget this and be glad that no eye damage was caused.

I don't think you really want to know my opinion but as a pushy, opinionated bastage you are going to hear it. You are both freakin' idiots. Let me extrapolate on my contention.

1) You are in possession of, and recklessly operating a Class IIIb laser system without a single FDA required safety system. Furthermore, you have knowingly participated in a felony by importing said Class IIIb laser system into the United States under false pretenses. Knowingly receiving a laser system shipped as a light device with a false harmonized tariff code is a felony. Even if you did not knowingly participate you may still have culpability.

2) Outside is no place for laser systems. When laser systems are operated outside, they are in full accordance with FDA and FAA regulation regarding over the horizon operation, field of fire, and beamstop/cleared airspace. Just like firing a weapon, you are responsible for where that beam terminates.

3) What the police officer did was reckless. However, the officer has no reason to believe the laser system is more powerful than a commonly available <5mW Class IIIa system. The officer arrived on a nuisance call not a brandishing a weapon call. Having knowledge of the true power of the laser may turn your learning experience into a full on prosecution if you press the issue.

4) Because you apparently have a need for the coolness factor you are risking the ability of all hobbyists to own systems. It only takes one court case to set precedence. With precedence in hand any lawmaker can use the case as justification to restrict ownership. This is not a second amendment right. Don't expect the NRA to come flocking to your aid to defend your right to shine lasers at people. Just like driving, owning a laser system is a privilege not a right. Think before you act. If you can't operate laser systems safely you have no business owning them.

5) I understand the laser is only a 30mW laser but that makes no difference. It is still a Class IIIb system. That is how the FDA will see it as well as the attorneys prosecuting an ownership case. The analogy could be made that there is no difference if you shoot someone with a .45 caliber or a .22 caliber, the result is the same; someone is shot.

Every time someone does something like this it's another nail in the coffin for the hobbyist. If you don't think the FDA has been watching the events in Australia you are wrong.

Looks like Razako saved me some typing. These are exactly my thoughts. FYI, lots of people need to understand, (parents included) that suing cops is the most difficult legal battle you will ever face, (without ROCK SOLID HARD evidence, like video), but usually it has to involve a beating, or unlawful arrest, falsely accused, etc. They work together behind the scenes to magically make absolute B/S into viable FACT to cover their own ass and to be the "hero" by sending the "bad guys" to jail. But in this case, face it, when I cop takes your marijuana and makes you poor it and smash it into the ground, he didn't make a report. Or, if he takes your weed without giving you a ticket, he didn't make a report. If he shines your laser in your eye to be a smart ass, he didn't make a report. The only way you would stand a chance with suing this guy, you will need to have a Judge, or DA, or a super attorney in your immediate family (who really loves you). I've learned that cops can be even dumber the average Joe at times, especially because of their over confidence and extreme pride.

Is there good quality video of the incident? No? Then let it go 100%.

After reading Frothy Chimp's response, another thought dawned on me. You should thank the cop for shining the laser in your eye and return to you. That was a 'cool' cop, not a "retard", because you could have been in big trouble. He could have confiscated your laser, arrested you, call your parents to pick you up (if your under 18) and have it on your record, probably give you a disruption of peace or some other infraction, or misdemeanor if the DA and the Judge are real pricks, you could have gone down for attempted murder or terrorist attack since you where shining it around in public. Most importantly, that was not common sense to begin with. I carry a laser around with me mostly everywhere, but I NEVER feel tempted to take it out and risk getting caught "accidentally" shining it somewhere I shouldn't. And, it is very disrespectful not to respect these types of "systems" as Frothy Chimp calls it, and spoil it for the rest of us. You should not feel victimized about this incident, in fact, you should feel lucky, and take it as a lesson for the future.

ok, I think I blew it in my first response - not completely, but left out some important stuff.

First, as usual I agree completely with Frothy - fault on both sides. My emphasis was on the police side because he was dealing with a minor, bullying and endangering him while acting under a badge of public authority. As for L4sers, being a minor is no excuse - but it does factor into the level of bad perpetrated by the cop.

I still think it would be good to educate that police officer. As before I think a lawsuit is inappropriate. I would suggest that the original 'victim' should be consulted: is he more upset by the laser indiscretion, or by the deliberate laser-in-the-eye? If the latter, then a formal complaint is in order.

As to the risk of endangering the hobby by making a fuss: balance your ability to carry your lasers anywhere, any time with having police who can do anything to you anywhere, any time - which is the more important issue? Legality of your toy is a moot point if a uniformed man with a gun can pull you over and do whatever he likes with you with impunity.

Cops are people just like the rest of us. There are good ones and bad ones, excellent ones and terrible ones. This cop may not be “cool”, but what he did was nothing considering the power gifted to him from the government. I’m dealing with a couple cases right now where the “Police” is another word for “Gangsters”, organized crime, imprisoning the innocent, ruining homes and good citizen’s lives. All their reports are lies, all their prosecution are lies. The truth is that the cop lost his cool and went wild, now they are ALL trying to protect their ass, and by doing so we NEED to go down. I have much faith in the truth, and I won’t stop fighting (legally). Face it, the kid is lucky he didn’t face one of those types of cops. As far as I’m concerned, they all are crooked. I actually bought a security system for my house mainly to protect my ass from the police!

The kid in the video was scared shitless and very nervous.  “Dude”, was the word he used, not "pig", or anything truly disrespectful because he could barely think clearly.  Do you think that kid will grow to respect the cops more?  The word "respect" has been completely taken out of contest now days, it's so unfortunate.  To me, respect is to honor, in a positive light toward another person.  To Officer Riverea (from the video) respect is to drop on your knees and kiss my feet, then wipe my ass. Respect goes two ways.  As an officer of the law, you need to keep your cool and handle situations professionally.
