LPC 826 negative pin needed or not?

Hello,
I am building LPC 826 laser, with lm317 driver
3 ohm resistor
2x CR2 3.0v batteries


So , my question is,
do I need to solder negative pin to heatsink (which carries negative from host body) or I can just remove it?

If i am right, the diode is case negative diode so there is no need to solder the negative pin to the heatsink

Yup, the negative pin is part of the body of the diode, it's already being fed into the heat sink.
