driver problem

i have built an driver from the diagram
it working and i can adjust the current
the battery i am using is li-po 7.2v
the diode working just fine
but my problem is
that when i measure the volt it shows the battery volt
it shows like 5.5-7.5 volt out
why its not regulating it to 3v?
i am using lm317
any suggestion?

Just post one thread. People will find it. Having it in more than one place gets confusing quickly.

this is my driver
and ive built another 1 with smt components
 
I see two pots and a resistor... Just curious, what diagram did you use? Why are three points of resistance?
 
well first of all the blue pot is for picking the voltage from the variable regulator
second the 3 points is useless only 2 are working :D i will remove the useless 1
the diagram is the same diagram in this site
its very big but it cant fit into aixiz module mount like the v4 rckstr but im working on it
