You answered your question.. The cold. If you warm the green lasers up in your hand before hand they will stabilize more quickly, but in the cold it takes a second or two kind of like a car engine warming up. (at least thats how my dragon laser works when its outside)

I see nothing wrong with what they are doing.. Be glad.. Any company would laugh at you if you dropped their product or took it apart and it no longer works.. And I bet asking for your money back might get you nothing. Take the new laser and ebay it.
