If you are really worried about it you should try laserglow. Apparently they have great success getting their lasers through customs because their lasers have all of the necessary safety features.
 
I think you might be worrying too much. Unless german customs is a lot stricter than US customs you should be fine considering the fact that I have successfully bought a small pile of illegal laser pointers from dealextreme.
