I think the word 'scam' and its derivatives are being used a bit to freely these days.

In my knowledge, scam means you actively go out there with the pure intention of stealing money. It doesn't seem to me like he's 'scamming' anyone. Otherwise he would of cleared off these forums a long time ago. More like he's just had a run of bad luck that has escalated over time.

Discredited dealer, yes. Caution should be used when buying from him, yes. Scammer, no.

Well... when you take money from someone and then later tell them "oh the focus is really messed up on it, btw" I think thats intentionally getting money when he knows the laser is effed up. I'm really surprised that no one has gone to the police, or even tried to contact his parents.

Well, it's issues like this that really blur the line between bad seller and scammer.

I think that line was crossed quite a while back.

As far as I know, with few exceptions he has shipped almost nothing for quite a long time. And this business of pleading with us to buy more stuff, so he can 'refund' previous buyers - how crazy is that?

This guy should be banned from posting any offers for sale, or solicitations for money in any form, until he has shipped out all sold items or refunded to all buyers.

I just received a PayPal payment - but not from BlueFusion.

It was from someone else (Things?) who purchased an open-can diode from Blue. The buyer was instructed to send her payment to me in order to satisfy Blue's debt to me.

This may be legit, but it feels fishy. Why would Blue have someone send me $30, and commit himself to shipping something to that person... when if he shipped my item to me, he would both satisfy his debt plus receive $30 more from me (as my final payment for my purchase)???

In other words, if he had sent the Kenom barrel to me he would be $30 better off than the deal he made with her.

So until that open-can is delivered, I have to think Blue is just playing games here, keeping the debt moving, stalling for time or hoping someone in the chain just forgets about it or something.

I'm placing that payment on hold until that LD is delivered to the buyer. If she doesn't receive it, I'll cancel her Paypal transaction to me, effectively refunding her mony, then I'll go after Blue legally. She is in Australia, as is Blue; that should present some opportunity for Australian prosecution if this is a further fraud.

I think that basically proves that he fraudulently sold you that barrel. I don't think he ever had it, because if he did he could just send it out and everything would be taken care of. That's pretty bad... selling things you don't have in order to pay other people back. :eek:

yeah... although I think he did have at least one... I've been wondering for a while now - how many people bought that barrel?

Exactly. Maybe someone else came along and offered a few bucks more than you, after he had already used your money to pay someone else back. Either way... I dont think there is ANY excuse that could make this situation even remotely ok...

All emails have stopped with him, and he hasnt sent me any for a long time. I am going to open disputes for all the money I have sent him, the only problem is that he probably doesnt have any money left...

Now im thoroughly pissed.

If he won't reply to your emails, then complain in this thread, if he won't hold up his end of the deal by sending you the laser then you don't have to obey his wished to keep that thread rant-free.

Blue, is it THAT HARD to put a laser in a package and ship out the thing?

I already filed the dispute, and ill post there as well. I was wrong about bluefusion. Apparently he is unable to send out a laser to someone or even an email.

blue got a total of 2 barrels from me.  so there was more than just the one that he had available.  what happened to them is beyond me.  I do know that daguin recieved one.  Just my $.02

I still have yet to recieve the shipment of drivers he sent me.  If it weren't for SenKat I wouldn't have recieved any drivers at all.  I think that Blue should ship out what he has for sale, then whomever he sends it to, can put them up for sale and instead of giving the money to blue, can then re-allocate the money to those that are still owed.

I think Avery should ban his sorry ass, and be done with it. Anyone who buys anything from this guy is a freaking idiot at this point. He needs to sell his shit at a flea market, not here - as I am sure everyone is sick and tired of his crap, false promises, and straight out lies. Let's be done with this guy - he has had his chance, and he well and truly blew it 100%.

exactly. I gave him his chance to send me money, the laser, or even an email or PM, but i have received none. So your chance for that is over. But im not just going to let this go, Im going to pursue this until i get my money back or my laser. If it were a small amount of money i would just let it go, but were talking over 600 dollars here.

If anyone has any suggestions for me thatd be great. I need to figure out how to get the money back, and ive filed a paypal dispute but im not sure what that will do because i doubt he has enough money to give back to me. If i win the dispute, will paypal lend me the money and then bluefusion will owe paypal? or will i not get the money until he gets money in his paypal?

Paypoo will pay you any money that is in his account which could be zilch..... You need to remember that you are not the first to try a charge back so you will be joining the queue.....If you funded the PP payment from your credit card you could try to get a refund through them then if you win you get the whole amount.

The other thing you could look at is a class action where all the people who can prove they are owed money get together and try to take him to court..... I am not sure if that can work across a number of countries though :-/
