The one marked "case pin - not used" can indeed be used to set up the case as the ground path by connecting the case pin and the negative pin.

I just bend the case pin over until it is touching the negative pin and solder them together.  Doing this allows you to use the case (and so the host) as the negative path.

negative pin -> case pin -> module -> heat sink -> host -> negative battery connection

In some applications this allows you to run the laser without the negative of the driver connected to the body of the host.  Sometimes one less wire will make the difference between fitting everything into the available space and not in a small host.  Also some hosts are designed to use the case as the negative path.
