tell him he needs to send it back delivery conf if you guys go that route so he cant claim you never got it either

i will, should i wait fot him to escalate the case case to the ebay admin and then refund it if they say i have to or just do it now, mainly i am trying to also avoid a bad rating

Make sure and communicate with him completely through the ebay messages, as they can be used as evidence. I would say offer to refund him upon receipt of the package. When he ships back the package, record video of opening it. Sometimes these scammers will not send back the right thing, or only part of it. In the end, if a dispute is made, appeal as much as possible. The more ruckus you make about being scammed(if it turns out to be one), the more likely that ebay/paypal will refund the buyer and eat the scam. They have lots of money. Also, from here on out be very careful about who you sell to. Watch out for things that stand out, such as excessive questions, asking to sell outside of ebay to avoid fees, offering more than what is listed. If anything strikes you as odd, tap the brakes.

ok thanks, the thing is he has a good 100 rating of both buying and selling various things and only asked if i could ship it out the next day if i could,
so so red flags came up

sorry for double post but i noticed something interesting, when he contacted me he said that there was no damage to the box and that i had to have shipped him broken pedals, i feel like this could be evidence that he is trying to scam me, because how could he know the shipping was not responsible for sure? also in his pictures he sent, they look a little different than the ones i sent, also the original packages i sent looks new and the ones he sent look old

I also have carbon pedals for road bike a very nice trek they cost over 200 and to break them
seems virtually impossible without smashing with a very large and heavy hammer i would say its a scam but what can you do ....sigh

The broken ones looks used !! Hes probbably trashed them on his first outing !

thats what i am saying or he had an identical pair he is trying to swap out

would i even have a chance in a dispute or do they already side with the buyer before even looking at the case?

When selling used items it is a good idea to take a scribe or whatever you want to use and make a small not noticable mark of the items and put a mark somewhere on the box that would allow you to identify them as items shiped That is what used car part people always do so they can identify the part as theirs.

Of course 20/20 hindsight is always easy.
