I just ordered a alpha 85 for NOVA lasers and I need to know if it is legal to own in Hawaii, not the the USA in general. NOVA said that it is legal to import lasers with all the safety features like the Alpha series but I have to know if it is for Hawaii. I really should have checked on this before hand but it slipped my mind :'( I already know the common sense stuff like dont point it at cars and planes but is there anything else? Any help on this would be great and sorry if there was already a topic on this. Will I get into trouble just owning one? Thanks

The web is a great resource for information. And with a little time on your part you'll find an answer

Okay, I confirmed it with hawaii customs that green lasers are permitted just so long as they are 5mw or less. Anything more and they will take it away "if" they find it.

I'd expect it would be legal to import a >5mW laser if FDA certified  :-? Or is Hawaii nothing to do with the US ?

If the alpha series is FDA certified then it should be perfectly legal to own. Just don't point it at planes and stuff and you should be fine.

This is only for pointers without the needed safety features.

Your alpha will be fine to import. It has an acession number from the FDA as well as ALL of the required safety features. You have nothing to worry about

FYI: Not to state the obvious here, but Hawaii is one of the 50 United States. The laws that affect the US would therefore affect Hawaii as well, with no difference.

Yeah wasn't sure if it was one of the 50 states, didn't want to comment without being 100% sure.

"Can battery-operated, portable laser systems be sold in the U.S?

Yes, battery-operated, portable laser systems can be sold in the U.S., providing that they fully comply with the standard, are certified and reported, and are not Class IIIb lasers sold or promoted for pointing or amusement purposes. "

There can be state laws prohibiting certain devices/practices/etc. that may take precedence over federal permittive laws, though I doubt Hawaii has any specifically prohibiting FDA-approved lasers.

Nova Alpha series portable lasers systems aren't sold for the purpose of personal amusement (although many who buy them do) you're not gonna find alpha series lasers in blister packs sitting at your local drugstore. They are completely fine to import as they have the full set of safety features and are registered with the FDA.
