Is this laser legal to sell in the US?

I would like to resell my 200mW red laser in the US. I have an understanding of the laws in the US but I want to be sure. This is my laser.

As shown, the laser is properly labeled. The button is maintained, not momentary. I'm not sure if it matters, but the beam is focus-able all the way from what looks like a flash light to a fine point. However, it does not have a key switch so is resale automatically illegal? I want to be certain about legalities before I attempt resale.

It's not legal, it doesn't look like it has any of the FDA safety features.

Maybe if you ship the batteries and laser separately?

You probably won't get in any trouble for selling it, and it most likely would not get confiscated in the mail, but it still is not legal. Perhaps if you took out the module, and then sold the module and the host separately, it might be considered a little more legal.

I think you are extremely over reacting, have a paranoid problem, or you are a government agent trying to obtain information.
Go to the buy, sell, trade thread and look around.
The prisons will be full long before they get to you.
Relax.

I just don't want to get sued if the person I sell too gets hurt or something and it lacks those features. That's what I mean by getting trouble. But I have seen similar lasers but far more powerful sell on that thread.

Survival Lasers is in the US and sells lasers legally without the FDA safety features. Just unscrew every part of the laser that is easy and practical to unscrew. Then you can legally sell it as a laser parts bundle, since your selling it as a bundle it has 0mW power and is legal, I've bought a laser like this on ebay without any issues.

Or you can install all the FDA requirements which to my knowledge only wicked lasers does that.
