I have ordered two 5mW lasers from DX and the customer service told me that my country (USA) now restricts import of lasers. I know there is a new ban on lasers that are above 5 mW but I'm not aware that the ban applies for ALL lasers.
I only ordered 5 mW lasers because they are relatively safe and are okay with FDA/customs.
So I contacted the customer support again and I'm waiting for the response. Should I still pursue this purchase or am I really risking that the customs will confiscate my lasers or fine/jail me?
The lasers say they are 5mW however on the sticker I've noticed it says class 3B laser. Maybe it's because of that?

I will reply, because I don't think anyone else is...

If it's 5mW it still may not be allowed. Though it has the US standards and you shouldn't get in trouble with it, it probably does not have the FDA number thing. Meaning the FDA has not approved this laser.

I may not be right, but I think I am.

I believe those lasers are cheaply made any way. (You get what you pay for). Why not pay $60 for a nice one?

The restriction from DX is for all lasers 5mw and up. You have to choose something smaller then 5mw to buy from DX as of now. Check ebay is all you're interested in is hosts.

Damn, that truly sucks!!!
Now I'm stuck with a little laser that is eating my button cell batteries like a pop corn and no decent laser in near future. :(
I wonder if there is any other way to get my hands on a nice 5 mW laser EXCEPT from ebay.
If you know about anything please send it to me privately. I hope there is some way around this BS.

Looks like they are going to ship it eventually. DX representative just told me they CAN ship it. Can't wait to get it.

That's good, I was thinking of ordering this and a host for a blu-ray. (What with DX and their slow shipping, might as well order everything at once.)

Partial success!  I received my first order today.  I have attached some photos.
That diagonal line on the dot is only visibile with a high end camera.  Wonder why?
Anyway I'm glad I got it and I'm anxiously waiting for the second order.

Ebay lasers aren't as bad as you think if they are only 5 mW. I bought a 5 mW Ebay laser for $13.60 (including shipping and insurance) from Ebay seller salostore, and it is the exact same model as the first DX one. I am impressed; the dot does go a mile and the beam is visible in the nighttime.

How bright is that keychain? I've been wanting to get a DX 5mw keychain for awhile now. I'm really leaning towards the lr44-powered style though, because it's smaller. I'd power it with rechargable 10180's (I think?) though. I also want the lr44 style one because it's pot mod-able, and I want to turn it down to about 2mw.

Cool buy.

Man I know how you feel.  I always wanted a key chain LP BUT I quickly grew out of it when my small key chain laser broke.  The button got stuck and now it's rather dangerous since the laser can go off at any time.  It has something to do with a connection.  I even disassembled it and you can see what button I'm talking about.  
Always wanted LR 44 powered laser but NO MORE.  The battery in it won't last more than a minute and if so, the dot becomes so dull it's no longer fun.  I even ordered a 50 batteries package from DX that calmed my pain a little bit.  Of course those batteries last significantly less than genuine batteries but for 4 bucks you can't go wrong.
Plus once you see the laser you will probably never hook it up to your keys, it simply won't sustain that kind of abuse.
The picture in previous posting is my new laser.  It's bright and you can see the beautiful line in the dark and dot is strong.  It's, however, not a key chain pointer.  It's thick, heavy and simply well built.  Nothing you would want on your keys.

Heres a quote i got from the FDA:

What specific laser are you trying to import without success?  The manufacturer, before import, must  certify that the laser conforms to the laser performance standard (and other requirements in 21 CFR Subchapter J) and must report the laser to CDRH.  This process has not changed.  Certain lasers fit the definition of surveying, leveling and alignment lasers:

Surveying, leveling, and alignment laser products defined in 21 CFR 1040.10(b)(39):

   "(39) Surveying, leveling, or alignment laser product means a laser
  product manufactured, designed, intended or promoted for one or more of
  the following uses:
(i) Determining and delineating the form, extent, or position of a
  point, body, or area by taking angular measurement.
(ii) Positioning or adjusting parts in proper relation to one
  another.
(iii) Defining a plane, level, elevation, or straight line."

The Federal Regulations, in 21 CFR 1040.11(b)(2), limit surveying, leveling, and alignment laser products to Class IIIa. i.e., 5 milliwatts in the visible spectrum:

  "(b) Surveying, leveling, and alignment laser products. Each surveying, leveling. or alignment laser product shall comply with all of the applicable requirements of § 1040.10 for a Class I, IIa, II or IIIa laser product and shall not permit human access to laser radiation in excess of the accessible emission limits of Class IIIa."

Alright,
I got my both orders and I'm so glad it finally came. It looks like anything >=5 mW has no problem.

Do you mean <5mw are no problem? Because it's the >5mW lasers that are the problem and are restricted?

Yes my bad, it's <= (less then or equal to 5 mW) are no problem to import. Thanks.

Well that's good to know we can import <= 5 mW lasers.

I do know that they do scrutinize looking at laser since my company has a shipment held by the FDA in Los Angeles, and the lasers are rated Class II, <1mW power. Probably since the shipment was a quantity of 2500.. they decided to take a close look.

omfg im pissed now... too many stupid ppl shining it at the wrong stuff makin them bann lasers... glad i got my 50mw green n my 200mw red
