Here's another problem.  Even if you go to an eye doctor and he finds damage how will you prove that it was caused by the officer?  You could have accidentally hit yourself in the eye plenty of times.  Unless you have a tape showing exactly what happened you will have no luck pursuing this further and it will be a waste of your time and money.

-Tape (I was rite near a building, and I am very friendly with the security guards there.)
-5 of my friends saw this happen
-There was a 911 call

No tort (damage, loss) , no case

Plus this sounds so much like a "dumbest" criminal scenario

Citizen: I want to report a theft

Officer: Yes sir. What was stolen

Citizen: 4 ounces of my best pot

Officer: OH REALLY! How do you know it was 4 ounces

Citizen: (produces a bag half full of marijuana) When I went into the bathroom there were 10 ounces in this bag. When I came out there were only 6 ounces in it. John Boy must have taken it.

Officer: May I weigh that to be sure?

Citizen: (hands over bag) Sure.

Officer: (sniffs in bag) Please place you hands on top of your head?

Citizen: LOL!! WUT?!?

Officer: "You have the right to remain silent . . . . "

Peace,

I always use a monocular to see if people or planes are around.

You could probably see a lawyer about this, they might have more knowledge on how you could win your case

No. its a 30mW and i'm shining it over 200-500 ft away. Inside if I shine it I make sure no one is around and that I have goggles on.

1) I shined the laser near the people by mistake. I was over 200-300 ft away, and It was really dark at night, they were all wearing black clothes, and I had no idea there were people. They told me that they assumed there laser hit their eye, but it was probably on the ground near them.

2) Now, the police officer got a 911 call stating that their was a laser being pointed near them, and that it was a "weapon" that may blind people. The police officer comes, takes the laser, and points in willingly into my eye, not by mistake, but knowing that it may blind people, and an un-identified "weapon".

We all make mistakes, but this police dude did it all knowing I could go blind. That's pure evil, and he should not be on the streets.

I think I have a better case. But think about it, what if I had a gun? Would he shoot me?!!!???

I agree the cop was in the wrong (pointing the laser at your eyes) and what he did was juvenile. I must also say that I use some of my lasers outside on occasion. However, when I do so (especially when it's dark, as would usually be the case when you would want to use a laser outside) I always make a concentrated effort to not ever point the beam at any place where a person could possibly be and be hit by it. For me that means pointing it at the ground or up into the trees or at the side of my house or a tree trunk.

I remember one night (it was twilight - almost dark) and I was walking up my street to my house,a nd I pulled out my 95mw greenie and shined it up into the tree tops in my yard.
Suddenly, seemingly out of nowhere, came a voice commenting on how bright the beam was. It was one of my neighbors, standing little more than 15 feet away from me! I didn't even see her there....it was a good thing I was pointing the laser up and not straight out - I might have hit her in the eye!

If you are going to use lasers outside, even on your own property, you have to be extremely conscious of where the beam will go. As others have said, you wouldn't point and fire a gun without knowing where/what the bullet will strike, even a BB gun. People who have done that have ended up injuring or killing other people.

Treating a high-powered laser like a loaded gun is a good thing and a good frame of mind to be in when handling such lasers.

Re: Retard Police officer shines 30mW laser in my

admittedly I haven't read this whole thread, just the first 6 pages... but still...

1. the cop seriously needs to be disciplined, or at least educated on how dangerous what he did was. regardless of the fact that you're using a laser against FDA regulations, so was the cop. As for the people saying "don't bother trying to pursue this the cops will just lie their way out of the lawsuit", well then, you may as well admit defeat, say the cops are above the law and that you live in a fascist state.. the legal system was put in place to protect the citizens, it's the only recourse you have. If it means potentially losing the freedom to wave shiny lights around, it's still better than having bullies with guns roaming the street thinking they're above the law. (oh wait, you already don't have that freedom and what you were doing is already probably outlawed)
2. you are not qualified to say if there's any damage to your eyes, only an optometrist is. You should really go and get a professional eye examination done, since your eyes can sustain a lot of damage that you may not notice for years.

at the very least you should go down there with your mom and explain that what the officer did is very dangerous and certainly uncalled for.

The cop was wrong by doing it. but if you sue you can bet they will test that laser and if class 3b you'll get prosecuted. Even if they don't prosecute, the cops can do all kinds of things to make your life a living hell. Some of these things include, planting drugs, searches with bs warrents, bs tickets and even worse stuff!

2 cents:Your mistake to begin with,BUT the cop was wrong to shine it in your eyes. Yes he SHOULD be disciplined,BUT this shouldn't be persued from a lagal sandpoint as it WILL damage the hobby.Soooooo what I would do is drop it and never speak of it to ANYONE again. Then I would allow it to fester in my heart- and nurture my festering feelings of revenge until they reach full maturity. While waiting for my fully grown rage to peak I would quietly collect all nescessary intelligence and calmly formulate a plan of action. When it did happen it would be a complete surprise and a total sucess with zero clues.Been there. SOMETIMES justice can ONLY be: JUST US.Final tip: NEVER, EVER cop to nothing.
