Thanks guys and a thing to note. When one person screws another over it will eventually screw us all over. Stick together and the scammers have a harder time scamming. Atleast people are acting mostly professional about this here which is a great thing to do. Shows the scammers they dont get much if any gratification.

This is just wrong on so many levels! I'm pretty sure his local Law enforcement would be interested in that picture of him with a gun :thinking: A phone call and his address may go far if it continues to escalate. The legal threat is even more ridiculous. I guess we're all cyberbullies now.

I totally agree with gift payments and signatures. Builders and Sellers shouldn't have to take any additional risks, especially when they are established and reputable members in the community. Otherwise a Vet as middleman is a good solution too.

I think you'll make that money back in no time SBA, and I hope there is some justice and a death threat trumps "cyberbullying" and a liar in the eyes of the Law.

While I do feel bad for sba's loss, it is a loss that all business owners take at some time.

This is what happens when you leave the hobby side of things and try to get in to the money side.
Risk vs Reward I guess.

SBA, you should acquire all the threats, and photos and all relevant information of this guy and forward it to the FBI internet crimes division. With all the shootings and bombings that have been happening lately, i'm sure they will at least contact him and scare the crap out of him.

Thanks, Michael. But, I'd just as soon keep the FBI out of the situation where our forum and our activities are concerned. Rumor has it they already hang around. No need to invite their scrutiny.

On the other hand, the USPS has a Fraud Dept. as far as I understand...

I'm still astounded that paypal ruled in his favor considering that you have many, multiple messages from the guy admitting that he received the item.

If nothing else that by itself is highly criminal.

Paypal will not even look or consider communication evidence outside of communications through the resolution center messaging system. What you are left with is a case of fraud which is a police/criminal matter which they don't want to get involved with. It may even fall into a category of insurance fraud which has pretty stiff penalties. But the bet is SBA would not take it that far based on the type of item he sold.

Btw, DTR, thank you for posting that $250 signature confirmation bit. It's news to me.

As a matter of practice I use only tracked shipping, but for anything over $200 I also add signature confirmation on.

I am surprised the amount of sellers here that don't know this. If you note every time you create a shipping label with paypal it says it right on the page.

Ahhh...I have never created a shipping label with paypal on account of my not having a printer.

For myself, I don't think I ever sold anything via paypal that was not a gift payment for stuff over ~$200. I checked through my account, and basically all the sales are for items in the $50 to ~$200 range, above that always gift. Still, for my own peace of mind I have always gotten signature confirmation, or insurance for more expensive packages.

I read he has admitted several times in written form that he HAS RECEIVED the item?
Maybe that doesn`t count for paypal, but you could contact a lawyer yourself and thread to sue him for fraud in the first place!

Honestly I think he didn`t have contact to a lawyer at all and that will shut him up quickly!

Maybe even the paypal issue can be solved that way!

That may be true shipping within the USA.
In Canada shipping within Canada we have a choice to add
Signature confirmation but we don't get the "Note" you circled.

Shipping from Canada to the USA we are not even given the
option to add Signature on any level of Tracked Postal Shipping
service so I would assume we are still covered for "Item Delivered"
data provided by Canada Post after a successful delivery.
(They may have changed policy since the last occurrence)

It has happened a few times in the past that a customer opened
a "Not Received" claim with PayPal and lost his claim due to the
Canada Post Tracking stating "Item successfully Delivered".

And for $2.20 why would a seller not buy a guarantee of delivery
if it is available for anything over $50...:thinking:

If we had the option when shipping to the USA we would certainly
take it...

I just seen the pic with the gun that's a little over the top maybe the guy was drunk or something you know how alcohol makes people do
strange things, in January a drunk girl ran into us and totaled our car so stupid shit happens when alcohol is involved sometimes.

As far as I can tell all this talk is not getting SBA his funds back let me see if I can do any thing to help, $350.00 is a lot to take on the
nose and all this boo hooing back and forth is doing nothing to solve anything, dose any one know if matty58 is on a temp or a perma ban ???

Sometimes a little sugar works better that a 2x4 when your trying to get a jackass to do something.

True! We need to stop complaining, it's happened, we need to get over it. We need to start to do something instead of continuously giving this guy crap. He is an ass, yes. But we need to figure out what to do to get SBA's money back.

I wonder what would happen if a few people from the forum sent Paypal emails/calls explaining the situation to them. Especially the death threat.

If the person you speak to actually has enough sense to realize SBA isn't the one to blame, I'm sure things should clear up a bit. We need matty's account to be terminated, not SBA's.
