Hi, I was going to buy the Viper 125mW from dragonlasers (I think I will anyways) , and I was searching about laser pointers and stuff and i found this:

Laser pointers are Class II or Class IIIa devices, with output beam power less than 5 milliwatts (<5mW). According to FDA regulations, more powerful lasers may not be sold or promoted as laser pointers.[30] Also, any laser with class higher than IIIa (more than 5 milliwatts) requires a key-switch interlock and other safety features.[31]

All laser products offered in commerce in the US must be registered with the US FDA, regardless of output power.[32

Now I'm confused. Does this mean it will be illegal for me to purchase any laser above 5mW? Does the 125mW have a key-switch? And are dragonlasers laser pointers registered with the FDA?

The Dragon Lasers and many other >5 mW lasers are sold in various countries where they are not against USA laws. The pen type does not become "legal" in the USA just because you have the tail key lock either, it needs several safety devices a "beam on" indicator, interlock (i.e. dongle), aperture cover, proper laser warning label, key lock and needs to have an FDA ascension number, the final proof, (if it is also properly labeled and equipped), then it is within the law here.
Short cut is go buy a LaserGlow Aries or Herc, or a OEM Systems laser, or a PGL III from CNI, (note not all CNI lasers are FDA compliant, but the PGL III ones are and most of those <5 mW and a few others are), and you can rest assured you bought a "lawful laser" then to use it lawfully you need some information. -Glenn

I was mainly concerned about getting it confiscated when it arrives in the US. That won't happen right?

No it won't if it complies with FDA regulations, You can order a laser of DX and not have to worry, customs only checks like .05% of the lasers imported so no worries bud. :)

Yeah customs is pretty easy to get by. You should have no problem getting your laser from DL through customs. My friend got his Viper 75 fine. You may want to contact their customer support to verify.
