If the shipper can show by Tracking... Signature or Delivery Confirmation
that the package arrived at the address on the label the case is decided
in favor of the shipper.

If on the other hand the Shipper can not prove that the package arrived
at the address on the shipping label the case is decided in favor of the
buyer.


Actually not entirely true, Jerry... A little while back there was a guy selling iphones on eBay, and sending out empty boxes. Tracking sure did show that the packages arrived, but there was nothing in them. eBay did decide in favor of the buyers.

So it's not quite as cut and dry there... Yes, buyers and sellers can both lie (and often do)... In indeterminable situations like that, at least once, I've seen paypal issue a partial refund.

Personally, every time I sold on eBay i didn't quibble about the extra $5 i'd have made by not putting insurance on the package, or demanding the seller pay for insurance. (note: insurance, above and beyond tracking). That way, whatever happens, there's some recourse. Or just wrap insurance, non-optional, into the shipping cost if the seller wants to recoup it, and considered a cost of business if they want to advertise a low shipping price or "FREE SHIPPING!"" etc.

Shipping insurance is (and should be) the "cost of doing business" when it comes to selling on the internet. Since the shipper must make the claim, telling the buyer "Well you didn't ask for insurance" doesn't really fly; it should be built into the auction shipping cost.

I've heard about that seller situation....
It becomes obvious to PayPal when more than one buyer
experiences the same "empty box" issues with the same
seller and PP Claims start coming in that the seller is scamming.

I'm only speaking of my active selling and buying experiences
on eBay in the past 4 years.... I've had experience on both ends
of transactions...
Just because I state my eBay/PayPal experiences that doesn't
make them law for everyone...:beer:

Sure thing Jerry. I understand it varies.

I just wanted to make sure eytyxhs knew that there was "some hope" for the situation, and that he should probably jump on it, and not wait a few days, as he said.

Thing is, most shipments have a 'built in' $100 of insurance. The shipper should be assisting him in at least trying to get that going, if it's there.

That may be so for shipping in the USA but in Canada
there is no built in insurance when shipping by Canada
Post unless you take a Shipping Service that offers it.

For instance if I send a light package or letter mail it has
absolutely no insurance included no matter the content
value.

I was also trying to state that he could win this Claim
since he has not received the head in his hands.

Looks like the seller is willing to make you a deal on
another head. I don't know the details of the the
deal so I can't comment on if it is fair.

I believe those heads are from the original eBay seller
that was selling them for ~$55.00 for a single head that
I was accused of buying by the old Kenometer Posse to
ruin Kenoms LPM sales. I'm sure that he paid a lot less
than ~$55.00 for the quantity that he seems to have
bought.

From the research I have done... Your eBay seller has sold
~100 heads since his first eBay auction.

"Pay the discount and shipping" - just sounds a little fishy to me. I may be paranoid (Well, no, I am when it comes to this stuff)..

He is technically meeting you half way...

We can't really send a message to him about your situation; it's kind of unprofessional and might be considered harrassment on eBay's terms...

"Choose your battles" , this may not be one to fight long term, but, I'd just worry if the second would arrive...

^^^I agree Just take his offer and be done with it. Lesson learned. When buying expensive stuff tell the person your buying from what kind of shipping Requirements you have.

Let all your Post men or women know to never leave it outside and to always ring your door bell. If you are not home dont leave it and just leave a "Pick Up Card" to go into your local post office to pick it up next day. This will save you the headaches.

I hope you get your head. I agree with the OP. If I paid for something and it didn't arrive or only partial of the package arrived.. I would NOT pay for a "deal". If I were in the OP shoes... I would fight this all the way even if it gets me nothing in the end. The only thing I WOULD pay for is shipping for another head.

Again, that's just my opinion and I wish you the best of luck.

I'm sorry to hear you didn't get your package :(

This its why when I buy anything worth more than $200 I get it sent to my PO box. I don't trust expensive items sitting somewhere where Joe public could get his hands on it. Plus, I have insurance on the box so that if the item goes missing in transit and the seller has proof of tracking, I still get my money .

Hope you at least get a partial refund (even though that's not ideal for you, its something)
