I suppose I should've elaborated myself. I side with --Hallucynogenyc-- in that if the seller can't be around to respond then he shouldn't be selling items while he's away. Paypal gave him plenty of time to at least respond and without doing so he automatically loses the dispute. Plus he's selling crappy lasers on ebay which aren't allowed to begin with. Also, I'm getting tired of seeing your posts and will be talking with C0ld as to why you're not banned yet.

The right thing to do would be to return the laser (I personally wouldn't bother... but it IS the right thing)
Also: Try not to go with the paypal claims-- it really hurts the seller...
You weren't ripped off or scammed... it is $8 more than the true 30mW and $3 more than the 50mW... I don't know why you would fuss over that amount...
The right thing to do would have been to close the claim when you received it... and then returned the laser for refund...

I'll say it again.... even if you win a claim and get a refund... the seller has a window of time
after you are awarded the claim Refund... to contest the Claim decision... with a "Proof of Delivery"
(if he has a proof of delivery)... and PayPal WILL reverse the Claim..
The Seller only needs to show proof of delivery... and PayPal will reverse the refund...for a period
of time.. even after the claim is closed... :eek:

Once the Time window closes... then the seller has no recourse...
And for $9.99 EUR... I don't think this will happen... ::)

Someone sees <80mW and assumes it is guaranteed 80mW output
when in fact... anything Less Than 80mW is as advertised...

That means if the Laser was only 10mW the statement <80 is still true...
and not a scam... :cool:

I alredy said i had many other things that make me think that.

@laserbee: he can't provide any tracking number because it was sent by normal mail.

@[ch12290]= Then how to go if he's not answereing lol. So what to do now. I mesage him saying "ey guy tell me your direction and I send you the laser becasue you were so good with me" He was like shit with me i'm not going to give the laser away for such an idiot. he had no education I'm not gona have it with him.


I doubt noone here would have done anything diferent than me.

lets just take Alberts word for what it is. Unless somebody personally knows that Albert is a liar. I believe him. and why would the seller change his name. and benm is correct too. The buyer has isnt responsible for freight costs on a defective product. I would never dream of doing that to my customers. :p

follow up. I sell used circuit breakers that weigh in the hundreds of pounds and freigh is in the hundreds as well. absorbing the cost of freight is just a part of biz. and some times the circuit breaker isnt worth the cost so i tell the customer i'll send out a different one and tell him to do whatever with the defective one

Well... Michael.... contrary to regular business practices....

If you received a defective eBay item and you win the PayPal claim against the Seller....
You the Buyer are required to pay for shipping the defective part back...
and you better add Tracking to that package... because if the Seller says he never
received it.... kiss your Defective item and your refund good-bye...

And this thread is about a defective eBay Item... ::)

That's completely false information, heck I couldn't even find a LP3997 laser (but I didn't look too long) but found a LDO CMOS regulator with that number.  :-? http://www.alldatasheet.com/datasheet-pdf/pdf/95624/NSC/LP3997.html

And I vote that it is the sellers fault here.  The buyer obviously didn't know much about lasers and because of this seller he had to browse the horizons.  But, as any buyer should keep in mind is that it is ebay and there are defiantly going to be many dishonest sellers, and buyers.  

For your info, unless you have much experience with lasers, you can only estimate a lasers power by 10-20mW if you're good, and those DX New Wish 30 mW lasers that you used for referencing comparison, vary all over the place, from less then 5mW to greater then 50mW.  There are no quality control at DX and DX do not rate these units and the Chinese manufacture of these cheapest of cheap green lasers don't have guarantees and a lot of time put the wrong label on the wrong laser.  But, these are the perfect lasers to scam people with on ebay also.   And judging from the item description, the seller must have forfeit the dispute because he knew that all of his specifications are wrong, even down to the battery size, so it would cost more then it's worth to investigate and he knew that he was of disadvantage anyway, and like Coherent said, he's probably scammed enough people to eat the cost of this one and still sleep fine.  

However, know that you're very lucky, as there are many others who have been royally screwed and didn't get this nice opportunity to get justice, so good for you!  :cool: Luck only goes so far though... don't get used to it!  :p

@ace82: Ye well thats just another sign of the seller attitude, as i said he just copied-pasted the description and changed the power. Also I'm sure he chagned the label for one of 80mW (Have someone ever seen a label saying 80mW?) and lets rock the party i sell it for 20[ch8364] (23 bucks or more) and it costs me 13, 10$ to the pocket. As i said him on the mail, ¡¡fuck u men!!!

I agree... normally... "no customer support" after a sale is a good indication that  the
seller knows his product is defective.
The one not holding up his end of the bargain is the Seller...
