Dangers Of Selling Lasers Here?

Hey all, just a question for US guys here.

Is it in any way illegal to sell 1w 445nm lasers on here to other fellow Americans?

I'm in Texas, and sold my 1w laser to a guy on here, also in TX.

But I guess I just worry too much... I'm scared of it being like a undercover cop or something haha.

But just wanna find info on here, to know for future references, and sales.

Lol I'm never gonna sell complete lasers :p it's not worth the risk... That happened to someone here before :eek:

I made one for a client last month. Had 3 pages worth of safety notes and made him sign a release form to protect me from any wrong doing he does with his laser. Or if he shows some one, they cant come back and sue me. Survival lasers sends you plenty of safety notes when you purchase a diode and module from them. If he was some random guy I would have made it a kit, to further protect me.

Yeah, this has been the reason I decided to pull back from any plans to sell lasers. I originally had planned to sell them but after hearing Moh's story and others I am concerned that there is too much at risk to sell complete lasers. I don't know what the legalities are regarding "kits" because obviously some sellers here use that angle.

Unless something changes, I don't think that I will sell lasers. All it would take is for someone to get mad at you and the FDA could easily do a sting operation on a seller here.

I know some Canadian sellers only sell to US customers in an attempt to weave through the legalities and that seems like a good plan, but I'm no lawyer so I don't know for sure.

Likewise, the person you sold the laser to should know the consequences of their actions, because you didn't make them use a laser incorrectly, they did. Who knows though, too many things have legality gray areas :(

Cars are legal.
Lasers, technically, are not.

Which is almost funny because more people will die and get injured in car accidents *today* than have ever been laser-related injuries and fatalities.

Never the less, law is the law. Selling complete lasers within a country with laws forbidding that exact same thing is not the smartest thing to do.

True, I guess without all the safety keys and all that, whatever they require now, they are illegal. Then again, it's illegal to drive without a license too, maybe we need to make a laser license, :p (Totally joking though, I don't want even more regulations).

Lasers are technically legal (at least in the U.S.), SELLING them (over 5mW) is not legal. Using them is legal as long as you don't use them in a way that violates some other law. The only law I am aware of in the U.S. specifically regarding lasers is the new law that makes it illegal to shine it an aircraft.

There are some crazy laws insn't there.

A few years ago it was illegal to sell fish and chips on Sunday. Selling chips was OK but not fish.
So the fish and chip shop sellers made it clear that you buy a bag of chips and get a free fish, therefore they were not breaking the law.

So....sell a battery with "free laser".. don't know if that's a way round it but might work???

Make no mistake. Selling handheld lasers over 5mW is illegal unless it has all the safety features listed by the FDA.
It doesn't matter how much pages disclaimer you write.
It is just how much risk you want to take for the coins.

All we can do is warning about the dangers of the lasers. We have the responsibility if anything goes wrong. I try to minimize it by including safety goggles and laser warning stickers at the sales.

tsteele93, says its only selling that's illegal, not ownership, so you could own a bomb in that case... or not:confused:

Oh I missed that. Very confusing these laws. I am not even sure in owning a laser is illegal in Canada since we can legally sell them to non-Canadians.

It is not just about having all the safety features... It is all about getting an ascension number from the FDA.
