Sure, The Arctic is not FDA Approved and as such is not a Legal 1W Laser within the USA, This means that any Police, or officer can at anytime take this laser from you, it also means if you where to sell this item within the USA and someone got hurt they could come after you for it due to the fact you sold an illegal item within the US,

Now don't get me wrong as you can tell many people sell these items and many of them get into the usa but if you read up they do get taken away as well if they are found entering the US. If i had the money right now i would buy it off you but i don't

and I'm just giving you a heads up that the Disclaimer really dose not cover you at all, don't want you to have a false sense of safety due to your Disclaimer.

Importing this laser isn't legal, owning it is but using it in public isn't. I'm fairly sure that's an accurate summarization of the law, but you can sell it without a problem.

sorry to be a bad news guy Prototype, if Importing the laser is not legal, then also selling it in the USA would also not be legal, Remember if the law say's this item can not be sent to the US then it is then easy to understand that selling it in the US would also not be legal

The FDA approval is for importation, not ownership.

According to U.S. Food and Drug Administration (FDA) regulations, more powerful lasers may not be sold or promoted as laser pointers.[43] Also, any laser with class higher than IIIa (more than 5 milliwatts) requires a key-switch interlock and other safety features.[44]

All laser products offered in commerce in the US must be registered with the FDA, regardless of output power

That would mean any Laser that is not on the FDA List would not be allowed to be sold within the US

Laser is in the process of being sold now to a guy in UK. Actually it IS FDA Approved. See the Wicked Laser site and see KipKay's video. It's fully legal. It's NOT legal to use in a "harming" way. Like shine at aircrafts and police and such.

Don't listen to WL or KipKay, it isn't FDA approved.

Simple if I sell this to someone in the UK is that illegal? If it's illegal. I want to be totally legal. Explain how KipKay did it. He didn't sell but he shipped it.

That just makes it illegal to sell or import, since the FDA derives it's authority to do this under the Interstate Commerce Clause of the Constitution.

There is no legal penalty for owning/possessing it, or operating it in a private manner that does not need FAA or FDA approval/waivers either.

Oh, and people WILL pay $300 for one that's in hand, here in the U.S. I've no doubt about it. However, with people making and selling their own 445nm lasers that actually are at 1000mW or more for under $200 and are easily focusable, you won't get it here.

With the various shortcomings of the Arctic very well known to the board, I predict more like $200, because there are still many of us enamored with it's cosmetic looks still, despite it's dubious construction otherwise. So I'd suspect that you'd get top dollar more on eBay, or the buy/sell/trade forums of a non-laser dedicated site.

But, if you are selling it here because you also want to be sure of a buyer who's safety conscious and knows what they're doing, because that's important to you too. Kudos!

Once again sorry to say but your mistaken, under us law Code of Federal Regulations, if you where to sell an item that the fda say's is not legal to be sold within the us you would be able to be held to the law for not following what they say. again many people due it and the chance of anything happening is very small but like i said this was just to tell the op that him saying that if something was to happen you can't do anything to him and that is not the case.

I'm 26 I take safety VERY seriouly. I personally don't even like to use a regular old red "laser" pointier. But If I can get in ANY legal trouble for selling or exporting then the sale is off! I'm not going to get in a legal mess to make some money. NOT WORTH IT!

xmguy Sell the laser to who ever you want bro, don't get my posts wrong man i don't think there's ever been a case where someone has been busted for selling lasers within the usa i could be wrong but i don't think so, just remember to tell them what not to do and leave it at that man, i was just telling you to be safe because as everyone knows In the USA you could be sued for looking at someone wrong LMAO sorry had to say it.

NO! If you hadn't told me. I would not have known. If I can't sell I can't sell. If I CAN LEGALLY I Will. I've got a guy in the wings wanting to buy at asking price in the UK. I'm just wanting that info.
