It isn't a 30mW unit, it is a 10mW unit without the power control so it runs the diode full blast and makes 30mW....

Yes it does, now, that is not to say the life will be very short, but it means that as the laser ages, it will decrease in power. When it was limited with the photodiode, it ran at well below the current limit, so as the diode ages and requires more current, it can slowly up the current to keep making 10mW, but still be below the limit.
